【摘要】：近年來(lái),隨著我國(guó)醫(yī)保制度改革的不斷推進(jìn)和完善,農(nóng)民工的醫(yī)保問(wèn)題越來(lái)越引起全社會(huì)的普遍重視。解決好農(nóng)民工的醫(yī)保問(wèn)題,是建立覆蓋全民的多層次醫(yī)保體系的重中之重。它是堅(jiān)持和落實(shí)以人為本的科學(xué)發(fā)展觀,實(shí)現(xiàn)經(jīng)濟(jì)社會(huì)全面、協(xié)調(diào)、可持續(xù)發(fā)展的迫切需要,同樣是全面建設(shè)小康社會(huì),促進(jìn)社會(huì)和諧的必然要求。在實(shí)踐過(guò)程中,我國(guó)的醫(yī)保制度并未給農(nóng)民工帶來(lái)等同于城鎮(zhèn)居民的便利,為了使農(nóng)民工真正受益于我國(guó)的醫(yī)療保險(xiǎn)服務(wù),應(yīng)享有的醫(yī)療保險(xiǎn)權(quán)利得以真正實(shí)現(xiàn),借助法律這個(gè)強(qiáng)有力的支持是十分必要的。當(dāng)前,隨著相關(guān)法律法規(guī)的不斷構(gòu)建與完善,全國(guó)各地尤其是農(nóng)民工較集中的區(qū)域,陸續(xù)發(fā)布了有關(guān)農(nóng)民工醫(yī)療保險(xiǎn)的實(shí)施規(guī)范,使農(nóng)民工醫(yī)保政策的約束力從義務(wù)上升為責(zé)任。所以,深入研究我國(guó)農(nóng)民工醫(yī)療保險(xiǎn)法律制度的相關(guān)問(wèn)題,不但有助于農(nóng)民工醫(yī)療平等權(quán)的實(shí)現(xiàn),有利于我國(guó)和諧社會(huì)的保障,而且對(duì)促進(jìn)我國(guó)經(jīng)濟(jì)發(fā)展具有深遠(yuǎn)的影響。文章由五個(gè)部分構(gòu)成,第一部分介紹了農(nóng)民工醫(yī)療保險(xiǎn)的選題背景和研究意義,簡(jiǎn)述該問(wèn)題的國(guó)內(nèi)外研究現(xiàn)狀,并提出文章的研究方法。第二部分系統(tǒng)闡述農(nóng)民工醫(yī)療保險(xiǎn)法律制度,首先簡(jiǎn)單闡述了農(nóng)民工醫(yī)療保險(xiǎn)法律制度的相關(guān)定義;其次簡(jiǎn)述其特征;再次,指出其作用。第三部分從我國(guó)農(nóng)民工醫(yī)療保險(xiǎn)法律制度的現(xiàn)狀出發(fā),分別由農(nóng)民工醫(yī)療保險(xiǎn)法律制度的初創(chuàng)階段、發(fā)展階段、重點(diǎn)轉(zhuǎn)移階段等角度闡述了其立法進(jìn)程,接著簡(jiǎn)述了農(nóng)民工醫(yī)療保險(xiǎn)法律制度的模式探索。第四部分在前文的基礎(chǔ)上,陳述了我國(guó)農(nóng)民工醫(yī)療保險(xiǎn)法律制度的缺陷及產(chǎn)生缺陷的原因,缺陷分別是農(nóng)民工醫(yī)療保險(xiǎn)制度立法滯后、農(nóng)民工醫(yī)療保險(xiǎn)法律監(jiān)督與實(shí)施機(jī)制薄弱,以及農(nóng)民工基本醫(yī)療保險(xiǎn)權(quán)轉(zhuǎn)移接續(xù)困難。產(chǎn)生缺陷的原因有我國(guó)城鄉(xiāng)二元結(jié)構(gòu)的阻礙和我國(guó)農(nóng)民工醫(yī)療保險(xiǎn)法治不完善。最后,依次從農(nóng)民工醫(yī)療保險(xiǎn)立法、農(nóng)民工醫(yī)療保險(xiǎn)基金籌措機(jī)制、農(nóng)民工醫(yī)療保險(xiǎn)監(jiān)督與實(shí)施機(jī)制、農(nóng)民工基本醫(yī)療保險(xiǎn)權(quán)轉(zhuǎn)移接續(xù)的角度,提出構(gòu)建我國(guó)農(nóng)民工醫(yī)療保險(xiǎn)法律制度的一些設(shè)想,力求能有助于我國(guó)農(nóng)民工社會(huì)保險(xiǎn)法律制度及其相關(guān)配套措施的建立和完善。
[Abstract]:In recent years, with the continuous promotion and improvement of the reform of medical insurance system in China, the medical insurance of migrant workers has attracted more and more attention of the whole society. It is the most important to establish a multi-level medical insurance system covering all the people. It is the urgent need to adhere to and implement the people-oriented scientific development concept and to achieve comprehensive, coordinated and sustainable development of the economy and society. It is also an inevitable requirement to build a well-off society and promote social harmony. In the process of practice, the medical insurance system of our country has not brought migrant workers the same convenience as urban residents. In order to make migrant workers really benefit from the medical insurance service in our country, the right of medical insurance should be truly realized. It is very necessary to use the strong support of the law. With the continuous construction and improvement of relevant laws and regulations, all parts of the country, especially in the areas where migrant workers are more concentrated, have issued the implementation norms of medical insurance for migrant workers one after another. The binding force of medical insurance policy for migrant workers is increased from obligation to responsibility. Therefore, in-depth study of the legal system of medical insurance for migrant workers in China is not only conducive to the realization of the equal right of migrant workers to medical care. The article is composed of five parts. The first part introduces the background and significance of the topic selection of medical insurance for migrant workers. The second part systematically expounds the legal system of medical insurance for migrant workers. First, it simply expounds the definition of the legal system of medical insurance for migrant workers. Secondly, its characteristics are briefly described. Thirdly, it points out its function. The third part starts from the current situation of the legal system of medical insurance for migrant workers in China, respectively from the initial stage of the legal system of medical insurance for migrant workers, the stage of development. From the point of view of the shift stage, the author expounds the legislative process, and then expounds the exploration of the legal system of medical insurance for migrant workers. Part 4th is based on the above. The defects of the legal system of medical insurance for migrant workers in China and the reasons for the defects are described. The defects are the lagging legislation of the medical insurance system of migrant workers and the weak legal supervision and implementation mechanism of the medical insurance of migrant workers. And the transfer of migrant workers' basic medical insurance rights is difficult. The reasons for the defects are the hindrance of urban-rural dual structure and the imperfect rule of law of migrant workers' medical insurance. Finally, from the migrant workers medical insurance legislation in turn. The mechanism of raising medical insurance fund for migrant workers, the supervision and implementation mechanism of medical insurance for migrant workers, and the transfer of the right to basic medical insurance of migrant workers are put forward, and some tentative ideas of constructing the legal system of medical insurance for migrant workers in China are put forward. It is helpful to establish and perfect the legal system of social insurance for migrant workers in China.
