我國企業(yè)規(guī)章制度的規(guī)制研究

【摘要】: 隨著勞動關(guān)系日益復(fù)雜化多樣化,為了促進企業(yè)生產(chǎn)的順利進行,迫切需要通過各種手段調(diào)整勞動關(guān)系。雖然有關(guān)勞動的法律法規(guī)可以起到一定的作用,但是和企業(yè)聯(lián)系最緊密的是企業(yè)規(guī)章制度。而目前企業(yè)規(guī)章制度還存在很多問題,引起勞動爭議頻繁發(fā)生。所以本文在分析這些問題的基礎(chǔ)上從勞動關(guān)系和法律的角度給出相關(guān)的政策建議。 本文首先客觀分析了企業(yè)規(guī)章制度研究的背景和理論依據(jù),提出完善企業(yè)規(guī)章制度的必要性:企業(yè)規(guī)章制度具有重要的地位,但是企業(yè)卻未加以重視,二者之間的矛盾,引發(fā)了勞動爭議,這給企業(yè)和勞動者都帶來了巨大的損失,所以有必要對企業(yè)規(guī)章制度加以健全和完善。然后分別從企業(yè)規(guī)章制度的參與民主性、制定程序規(guī)范性、可操作性等方面詳述目前企業(yè)規(guī)章制度存在的問題。而最根本的問題在于企業(yè)中勞資雙方的不平等地位,所以解決這些問題就需要健全員工參與管理的制度。同時在操作層面上提出了要規(guī)范制定程序同時完善相應(yīng)法規(guī)并增強可操作性。本文的政策建議不僅著眼于微觀的條款,更立足于宏觀制度體系對企業(yè)規(guī)章制度進行了研究。 本文突破以往研究規(guī)章制度僅從法律方面研究的角度,指出勞動關(guān)系理論在企業(yè)規(guī)章制度制定中的重要性,并以此作為文章研究的重要角度,對企業(yè)規(guī)章制度進行規(guī)制,完善企業(yè)規(guī)章制度,希望減少因此而造成勞動爭議引起的損失。
[Abstract]:With the increasing complexity and diversification of labor relations, in order to promote the smooth progress of enterprise production, there is an urgent need to adjust labor relations through various means, although labor laws and regulations can play a certain role. But the most closely related with the enterprise is the enterprise rules and regulations. But at present, there are still many problems in the enterprise rules and regulations. Therefore, based on the analysis of these problems, this paper gives some relevant policy suggestions from the angle of labor relations and law. Firstly, this paper objectively analyzes the background and theoretical basis of the study of enterprise rules and regulations, and puts forward the necessity of perfecting enterprise rules and regulations: the enterprise rules and regulations have an important position, but the enterprise does not attach importance to them. The contradiction between the two causes labor disputes, which brings huge losses to enterprises and workers. Therefore, it is necessary to perfect and perfect the enterprise rules and regulations. In terms of maneuverability, the problems existing in the present enterprise rules and regulations are described in detail, and the most fundamental problem lies in the unequal position of both labor and capital in the enterprise. Therefore, to solve these problems, we need to improve the system of employee participation in management. At the same time, at the operational level, we put forward to standardize the procedures and improve the corresponding laws and regulations and enhance the operability. The policy recommendations of this paper not only focus on micro-level. The terms of view. More based on the macro system of corporate rules and regulations were studied. This paper breaks through the previous research on rules and regulations only from the perspective of law, points out the importance of labor relations theory in the establishment of enterprise rules and regulations, and as an important angle of the article. To regulate the enterprise rules and regulations, perfect the enterprise rules and regulations, hoping to reduce the loss caused by labor disputes.
