農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)法律制度研究

【摘要】:改革開(kāi)放三十多年來(lái),農(nóng)村經(jīng)濟(jì)迎來(lái)了繁榮發(fā)展時(shí)期,傳統(tǒng)農(nóng)業(yè)向現(xiàn)代農(nóng)業(yè)轉(zhuǎn)型發(fā)展,第二、第三產(chǎn)業(yè)對(duì)農(nóng)村剩余勞動(dòng)力更具吸引力,農(nóng)村剩余勞動(dòng)力向城市遷移,土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)出現(xiàn)了加速和呈現(xiàn)了適度規(guī)模經(jīng)營(yíng)的趨勢(shì)。農(nóng)業(yè)穩(wěn)定,則天下安定!叭r(nóng)”問(wèn)題關(guān)系到中國(guó)全面建設(shè)小康社會(huì)目標(biāo)能否實(shí)現(xiàn),其中土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)是學(xué)術(shù)界研究農(nóng)村土地問(wèn)題同時(shí)也是研究“三農(nóng)”問(wèn)題的一個(gè)熱點(diǎn)。土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)改革成為農(nóng)村土地制度改革的主旋律之一。十七屆三中全會(huì)《中共中央關(guān)于推進(jìn)農(nóng)村改革發(fā)展若干重大問(wèn)題的決定》清晰地指出:“要加強(qiáng)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)管理和服務(wù),建立健全土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)市場(chǎng),按照依法自愿有償原則,允許農(nóng)民以轉(zhuǎn)包、出租、互換、轉(zhuǎn)讓、股份合作等形式流轉(zhuǎn)土地承包經(jīng)營(yíng)權(quán),發(fā)展多種形式的適度規(guī)模經(jīng)營(yíng)。有條件的地方可以發(fā)展專(zhuān)業(yè)大戶(hù)、家庭農(nóng)場(chǎng)、農(nóng)民專(zhuān)業(yè)合作社等規(guī)模經(jīng)營(yíng)主體。土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn),不得改變土地集體所有性質(zhì),不得改變土地用途,不得損害農(nóng)民土地承包權(quán)益!薄白ゾo完善相關(guān)法律法規(guī)和配套政策,規(guī)范推進(jìn)農(nóng)村土地管理制度改革。”接著在2010年,中共中央一號(hào)文件《中共中央、國(guó)務(wù)院關(guān)于加大統(tǒng)籌城鄉(xiāng)發(fā)展力度,進(jìn)一步夯實(shí)農(nóng)業(yè)農(nóng)村發(fā)展基礎(chǔ)的若干意見(jiàn)》又提出穩(wěn)定和完善農(nóng)村基本經(jīng)營(yíng)制度,健全農(nóng)村土地承包領(lǐng)域立法,保證農(nóng)村土地承包關(guān)系穩(wěn)定,重視土地承包管理工作。 加強(qiáng)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)管理,提升土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)服務(wù),改善土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)市場(chǎng),在依法、自愿、有償流轉(zhuǎn)的原則基礎(chǔ)上推動(dòng)經(jīng)營(yíng)模式實(shí)現(xiàn)多元化。嚴(yán)格執(zhí)行和落實(shí)土地承包經(jīng)營(yíng)糾紛解決的相關(guān)法律規(guī)定,使農(nóng)村土地承包經(jīng)營(yíng)糾紛解決體制健全。在權(quán)屬性質(zhì)明確、管理非常規(guī)范、承包責(zé)任到戶(hù)的基礎(chǔ)上,改革基本經(jīng)營(yíng)制度,推行開(kāi)展農(nóng)村集體產(chǎn)權(quán)制度改革試點(diǎn)。新《物權(quán)法》以《農(nóng)村土地承包法》為依托,來(lái)規(guī)范農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn),這尤顯得對(duì)農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)方面的研究更為迫切。有關(guān)農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的有關(guān)問(wèn)題,引起了法學(xué)界許多學(xué)者的關(guān)注。值得注意的是學(xué)者們?cè)陉P(guān)于土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的研究上存在內(nèi)涵不清的問(wèn)題,除此之外體系不夠完整、論述不夠詳細(xì)、流轉(zhuǎn)方式研究過(guò)于封閉等問(wèn)題也不容忽視。 本文首先介紹了本課題的研究對(duì)象,對(duì)農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)法律制度作了概述,介紹了土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的概念、特征、歷史沿革、其現(xiàn)實(shí)意義以及立法現(xiàn)狀。圍繞學(xué)術(shù)界有關(guān)的觀(guān)點(diǎn)進(jìn)行綜述,對(duì)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的內(nèi)涵、性質(zhì)和意義進(jìn)行了探討分析,并對(duì)我國(guó)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)法律制度的歷史進(jìn)行回顧以及做出一些思考,還對(duì)我國(guó)現(xiàn)有土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的立法現(xiàn)狀做了介紹。 第二部分主要是通過(guò)了解我國(guó)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)制度中存在的問(wèn)題,在肯定我國(guó)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)法律制度所取得的重大進(jìn)步的同時(shí),思考其中尚存在的一些不足,例如,法律體系的不完善;流轉(zhuǎn)內(nèi)容科學(xué)性的欠缺;流轉(zhuǎn)程序上的問(wèn)題等等,并對(duì)存在的這些問(wèn)題進(jìn)行了分析。 第三部分是本文寫(xiě)作的重點(diǎn),主要是對(duì)我國(guó)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)制度的完善提出建議和構(gòu)想。例如,完善立法,加強(qiáng)法律的可操作性;拓寬土地承包經(jīng)營(yíng)權(quán)主體的范圍;科學(xué)界定土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的內(nèi)涵;規(guī)范土地流轉(zhuǎn)的過(guò)程等等。通過(guò)前幾部分對(duì)我國(guó)土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)制度發(fā)展的回顧以及存在問(wèn)題的分析,結(jié)合我國(guó)當(dāng)前的國(guó)情,對(duì)現(xiàn)有的土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)制度進(jìn)行一些完善,促進(jìn)我國(guó)農(nóng)村土地承包經(jīng)營(yíng)權(quán)更加健康地流轉(zhuǎn),為進(jìn)一步增加農(nóng)民收入,提高農(nóng)民生活水平,活躍農(nóng)村經(jīng)濟(jì)提供制度上的建議。
[Abstract]:Over the past 30 years of reform and opening up, the rural economy has ushered in a period of prosperity and development. Traditional agriculture has transformed into modern agriculture. Secondly, the tertiary industry is more attractive to the rural surplus labor force. The rural surplus labor force has migrated to the cities. The transfer of land contractual management rights has accelerated and shown a trend of moderate scale operation. The issue of "agriculture, countryside and farmers" is related to the realization of the goal of building a well-off society in an all-round way in China. The transfer of land contractual management right is a hot topic in the academic circle to study the rural land issue as well as the issue of "agriculture, countryside and farmers". The Third Plenary Session of the Seventh Central Committee of the CPC clearly pointed out in the Decision of the CPC Central Committee on Several Major Issues Concerning the Promotion of Rural Reform and Development: "It is necessary to strengthen the management and service of the transfer of the right to contractual management of land, establish and improve the market for the transfer of the right to contractual management of land, and allow farmers to subcontract, lease, exchange, transfer and share cooperation according to the principle of voluntary compensation according to The transfer of the right to contractual management of land in various forms and the development of moderate scale management in various forms can be carried out in localities where conditions permit the development of large specialized households, family farms, farmers'professional cooperatives and other large-scale management entities. The transfer of the right to contractual management of land shall not change the nature of collective ownership of land, change the use of land, or damage the contractual rights and interests of farmers in land. "Pay close attention to improving relevant laws and regulations and supporting policies, standardize and promote the reform of rural land management system." Then in 2010, the No.1 document of the CPC Central Committee < the CPC Central Committee, the State Council on increasing the overall planning of urban and rural development, and further consolidate the basis of agricultural and rural development in a number of opinions > and put forward to stabilize and improve the basic rural management. We should improve the legislation in the field of rural land contracting, ensure the stability of rural land contracting relations and attach importance to land contracting management.
Strengthen the transfer management of land contractual management rights, enhance the transfer service of land contractual management rights, improve the transfer market of land contractual management rights, promote the diversification of management modes on the basis of the principle of legal, voluntary and paid transfer. Strictly implement and implement the relevant legal provisions for the settlement of disputes over land contractual management, so as to make rural land contractual economy. On the basis of the clear nature of property rights, very standardized management and contractual responsibility to the household, the basic management system should be reformed and the rural collective property rights system should be carried out as a pilot project. The research on the transfer of contractual management right of rural land is more urgent. The problems related to the transfer of contractual management right of rural land have attracted the attention of many scholars in the field of law. The study of transfer mode is too closed.
Firstly, this paper introduces the research object of this subject, summarizes the legal system of the transfer of rural land contractual management right, introduces the concept, characteristics, historical evolution, practical significance and legislative status of the transfer of land contractual management right. The significance is discussed and analyzed, and the history of the legal system of land contractual management right transfer in China is reviewed and some reflections are made. The present legislative situation of land contractual management right transfer in China is also introduced.
The second part is mainly through understanding the problems existing in the circulation system of land contractual management right in China. While affirming the great progress made in the legal system of land contractual management right in China, it also considers some shortcomings, such as the imperfection of the legal system, the lack of scientific circulation content, and the circulation procedure. The problems and so on are analyzed.
The third part is the focus of this paper, mainly put forward suggestions and ideas to improve the system of land contractual management right transfer in China. For example, improve legislation, strengthen the operability of the law; broaden the scope of the subject of land contractual management right; scientifically define the connotation of land contractual management right transfer; standardize the process of land transfer and so on. Through reviewing the development of the transfer system of land contractual management right in our country and analyzing the existing problems, and combining with the current situation of our country, this paper makes some improvements on the existing transfer system of land contractual management right, promotes the healthy transfer of rural land contractual management right in our country, and further increases the income of farmers and raises farmers'income. Living standards and providing active institutional proposals for rural economy.
