【摘要】：事后搶劫存在未遂形態(tài)。事后搶劫中的“犯盜竊、詐騙、搶奪罪”并不意味著行為人在事實(shí)上要構(gòu)成盜竊罪、詐騙罪、搶奪罪,而是意味著行為人有犯盜竊、詐騙、搶奪的故意和行為；事后搶劫中暴力或暴力威脅的程度必須與搶劫罪中的暴力、脅迫處于同等的程度,即必須達(dá)到足以壓制被害人反抗的程度,并且這種暴力或暴力威脅的對(duì)象不必是盜竊、詐騙、搶奪的被害人,還可以是目擊犯罪行為而追蹤來(lái)的第三人；事后搶劫中的當(dāng)場(chǎng)一是指實(shí)施盜竊、詐騙、搶奪行為的現(xiàn)場(chǎng),二是指在盜竊等行為的現(xiàn)場(chǎng)或剛一離開(kāi)該現(xiàn)場(chǎng)就被人及時(shí)發(fā)現(xiàn)而立即追捕過(guò)程中的場(chǎng)所,另外,暴力或暴力威脅行為必須是在“盜竊的機(jī)會(huì)還在繼續(xù)中”實(shí)施的。事后搶劫的實(shí)行行為是行為人為了窩藏贓物、抗拒抓捕或毀滅罪證而實(shí)施的暴力、暴力威脅行為。事后搶劫未遂的認(rèn)定要分為兩種情形,當(dāng)行為人在前行為中取得財(cái)物時(shí),此時(shí)重點(diǎn)保護(hù)的法益是財(cái)產(chǎn)權(quán)益,應(yīng)以是否取得財(cái)物為標(biāo)準(zhǔn)；當(dāng)行為人在前行為中未取得財(cái)物時(shí),此時(shí)重點(diǎn)保護(hù)的法益是人身權(quán)益,應(yīng)以是否造成他人輕傷以上后果為標(biāo)準(zhǔn)。事后搶劫存在預(yù)備階段的中止但是卻不具有可罰性。事后搶劫中止的時(shí)間條件是行為人當(dāng)場(chǎng)實(shí)施暴力或暴力威脅的過(guò)程之中；事后搶劫中止自動(dòng)性條件是行為人的主觀內(nèi)容是自愿放棄非法占有他人財(cái)物或者抗拒抓捕、毀滅罪證的意圖,并且在客觀上停止了暴力或暴力威脅行為,另外在判斷事后搶劫中止的自動(dòng)性時(shí),應(yīng)以犯罪中止的法律性質(zhì)為指導(dǎo),同時(shí)采取逐步判斷的方法；事后搶劫中止的有效性條件是行為人自動(dòng)放棄了暴力、暴力威脅行為,并且以后也不再繼續(xù)實(shí)施,當(dāng)中止行為與犯罪結(jié)果沒(méi)有發(fā)生之間不存在因果關(guān)系以及行為人自動(dòng)放棄了重復(fù)的侵害行為時(shí),也成立中止犯。
[Abstract]:The crime of theft , fraud and robbery in post - robbery doesn ' t mean that the perpetrator is in fact guilty of theft , fraud and robbery , but it means that the perpetrator is guilty of theft , fraud and robbery ;
The degree of violence or threat of violence in post - robbery must be equal to the violence and coercion in the crime of robbery , i.e . , to the extent that it is sufficient to suppress the victim ' s resistance , and that such violence or threat of violence does not have to be a victim of theft , fraud , robbery , or a third person who can be traced by a criminal act ;
The act of post - robbery is to be divided into two situations : when the perpetrator acquires property in the former behavior , the law benefits of re - point protection are the property rights and interests and whether the property is obtained as the standard ;
When the perpetrator did not obtain the property in the previous act , the method of re - point protection should be the person ' s rights and interests , which should be based on whether or not the above - mentioned consequences should be caused .
The subjective content of post - robbery suspension is that the actor ' s subjective content is voluntarily giving up illegal possession of his property or resisting arrest , destroying the intent of the crime , and objectively stopping the acts of violence or violence . In addition , it should be guided by the legal nature of the suspension of the crime and adopt a step - by - step judgement when judging the automatic nature of the robbery .
The validity condition of post - robbery suspension is that the perpetrator automatically gives up the violence , acts of violence and no longer continues to implement it , and when the result of the suspension does not have a causal relationship with the result of the crime and the perpetrator automatically gives up the repeated violations , the perpetrator is also established .
