【摘要】：對(duì)"公共安全"的界定,新近理論的"不特定說(shuō)""多數(shù)人說(shuō)"以及對(duì)"安全"的擴(kuò)充都無(wú)法有效說(shuō)明"公共安全"的內(nèi)涵。而"通說(shuō)""不特定多數(shù)人的人身、財(cái)產(chǎn)安全"既符合法律語(yǔ)詞的文義解釋規(guī)則,又能準(zhǔn)確說(shuō)明公共安全和個(gè)人安全的區(qū)別,應(yīng)當(dāng)成為裁判準(zhǔn)據(jù)。"不特定人"的判斷標(biāo)準(zhǔn)在于犯罪對(duì)象的可替代性和犯罪后果的不可控性;"多數(shù)人"意指犯罪行為實(shí)際或可能造成3人以上人身、財(cái)產(chǎn)的損害,它著眼于犯罪結(jié)果蔓延和輻射的可能。堅(jiān)持上述界定標(biāo)準(zhǔn),有利于司法實(shí)踐明晰危害公共安全犯罪和具體人身、財(cái)產(chǎn)犯罪之間的界限,做到正確適用法律。
[Abstract]:The definition of "public safety", the new theory of "not specific", "the majority theory" and the expansion of "security" can not effectively explain the connotation of "public security". "General Theory" not specific to the majority of the person, property security "not only accord with the legal terms of the meaning of interpretation rules, but also can accurately explain the difference between public safety and personal security, should become the basis for adjudication." The criterion for determining "non-specific persons" lies in the substitutability of the object of the crime and the uncontrollable nature of the consequences of the crime; "majority" means that the criminal act actually or may cause damage to the person or property of more than three persons, It looks at the spread of crime and the possibility of radiation. It is helpful for judicial practice to clarify the boundary between crime of endangering public security and crime of specific person and property, and to apply the law correctly.
