【摘要】：正根據刑法第一百七十六條之一的規(guī)定,拒不支付勞動報酬罪的主體是"用人者",包括自然人和用人單位。區(qū)別于機關、團體和事業(yè)單位,司法實踐中,由于公司、企業(yè)(包括合伙企業(yè))等經濟組織形式的多元性和實際運營的復雜性,如何準確界定拒不支付勞動報酬罪的自然人主體,需要進一步探析。一、法定代表人不當然是"直接負責的主管人員"按照刑法第一百七十六條之一第二款的規(guī)定,拒不支付勞動報酬罪的自然人主體包括對單位
