論以危險方法危害公共安全罪擴(kuò)大適用成因及罪質(zhì)

【摘要】：以危險方法危害公共安全罪本應(yīng)行使保障公共安全的職能,但案情的錯綜復(fù)雜,法律關(guān)系的難以梳理使得以危險方法危害公共安全罪適用兜底。但是即使是罪名兜底化,也能夠按照犯罪構(gòu)成不法且有責(zé)的位階順序進(jìn)行兜底原因的解析。防止罪名兜底化應(yīng)使人身安全應(yīng)當(dāng)作為公共安全的核心與保護(hù)法益邏輯前提,并按照法條關(guān)系進(jìn)行同類解釋,并利用罪數(shù)原理妥善解決與相關(guān)犯罪之間的關(guān)系。
[Abstract]:The crime of endangering public safety by dangerous method should have exercised the function of ensuring public safety, but the complexity of the case and the difficulty of combing the legal relationship make the crime of endangering public safety by dangerous method applicable. However, even if the charge is peddled, the causes of the crime can be analyzed according to the order in which the crime constitutes illegal and responsible. In order to prevent the charge from turning into a foundation, personal safety should be regarded as the core of public safety and the logical premise of protecting legal interests, and the same kind of interpretation should be carried out according to the relationship between the law and the law, and the relationship between personal safety and related crimes should be properly solved by using the principle of crime number.
