【摘要】：目前研究公益事業(yè)或者慈善事業(yè)的法學(xué)類成果一般傾向于從立法的角度或者公益或者慈善組織的角度去考察。本文則著力于從民事法律關(guān)系層面分析公益捐贈(zèng)行為，風(fēng)起于青萍之末，如果不對(duì)概念本身做出一個(gè)明確的界定，那由此概念而起的所有種種，，都是沒有根基的。一般來說對(duì)于公益捐贈(zèng)的是怎樣的屬性主要存在以下觀點(diǎn)：一是附義務(wù)的贈(zèng)與合同行為；一是信托行為。 公益信托是國(guó)外主流的公益事業(yè)發(fā)展類型，主要是指英美法系國(guó)家以及較早引入信托法概念的部分大陸法系國(guó)家，但在大陸法系國(guó)家因?yàn)橛邢鄳?yīng)的法律概念承擔(dān)了大部分信托法律關(guān)系的功能，比如委托、附條件或者附義務(wù)贈(zèng)與等概念，使得信托法在使用范圍上仍只局限在商法領(lǐng)域，在公益事業(yè)領(lǐng)域，由于在先存在公益法人的概念并起著主導(dǎo)作用，使得公益信托并沒有發(fā)展起來，最明顯的例子就是日本在信托法生效后長(zhǎng)達(dá)幾十年都沒有公益信托的實(shí)踐，在我國(guó)也只是說只有一二期有始無終的以公益屬性為主要內(nèi)容的信托類產(chǎn)品。也就是說目前中國(guó)實(shí)踐中的公益捐贈(zèng)行為仍然是以附義務(wù)的贈(zèng)與合同為主要模式，在目前的公益事業(yè)亂象中，捐贈(zèng)人往往缺位，很少看到這一主體積極維護(hù)自身的權(quán)利。 本文即主要關(guān)注捐贈(zèng)人的權(quán)利及其救濟(jì)問題。本文的主體內(nèi)容有這幾部分： 第一部分：介紹公益捐贈(zèng)的概念、性質(zhì)，并區(qū)分了公益捐贈(zèng)法律關(guān)系的主客體； 第二部分：介紹了公益捐贈(zèng)人權(quán)利的性質(zhì)及其內(nèi)容； 第三部分：分析了公益捐贈(zèng)人權(quán)利的實(shí)現(xiàn)障礙及其原因； 第四部分：介紹了公益捐贈(zèng)人權(quán)利的救濟(jì)途徑。
[Abstract]:At present, the legal achievements of research on public welfare or philanthropy tend to be investigated from the angle of legislation or from the angle of public welfare or charitable organization. This paper focuses on analyzing the behavior of public donation from the perspective of civil legal relations. The wind begins at the end of the duckweed, and without a clear definition of the concept itself, all the things that arise from it, Generally speaking, there are the following points of view about the attribute of public donation: first, the act of donating contract with obligation; one is the behavior of trust. Public trust is the mainstream type of public welfare development in foreign countries. It mainly refers to the countries of common law system and some civil law countries that introduced the concept of trust law earlier. However, in the countries of civil law system, because of the corresponding legal concepts, they assume most of the functions of trust legal relations, such as entrustment, conditionality or gift of obligation, so that the scope of application of trust law is still limited to the field of commercial law. In the field of public welfare, due to the existence and leading role of the concept of public welfare legal person in the past, the public trust has not developed. The most obvious example is that Japan did not have the practice of public trust for decades after the Trust Law came into effect. In our country, we only say that there are only one or two trust products whose main content is the commonweal attribute. That is to say, at present, the behavior of public welfare donation in Chinese practice is still based on the giveaway contract with obligations as the main mode. In the current chaos of public welfare, donors are often absent and seldom see this subject actively defending their rights. This paper focuses on the rights of donors and their relief. The main contents of this paper are as follows:. The first part introduces the concept and nature of public donation, and distinguishes the subject and object of the legal relationship of public donation; The second part introduces the nature and content of the rights of public welfare donors. The third part analyzes the obstacles to the realization of the rights of public welfare donors and the reasons; The fourth part: introduced the relief way of the public welfare donor's right.
