【摘要】：服務(wù)型政府已經(jīng)成為我國(guó)政府管理發(fā)展的明確目標(biāo)。行政相對(duì)人公共服務(wù)請(qǐng)求權(quán)的實(shí)現(xiàn)情況,從權(quán)利與義務(wù)的角度反映了服務(wù)型政府建設(shè)是否落到法治的實(shí)處,是我國(guó)打造服務(wù)型政府的制度突破口。但該權(quán)利的實(shí)現(xiàn),從理論、制度到實(shí)踐都存在著諸多問題。為此,理論上需要通過逐步厘定行政相對(duì)人公共服務(wù)請(qǐng)求權(quán)標(biāo)準(zhǔn)及范疇;制度上需要依據(jù)法理進(jìn)行科學(xué)合理的設(shè)計(jì);實(shí)踐中需要采取加大財(cái)政支持力度、建設(shè)電子政務(wù)平臺(tái)等措施。突破以往請(qǐng)求權(quán)傳統(tǒng)思維的局限,可以帶來我國(guó)公共服務(wù)體制的重大轉(zhuǎn)型,保障行政相對(duì)人的權(quán)利在制度上獲得明確的保障。
[Abstract]:Service-oriented government has become a clear goal of the development of government management in our country. The realization of the right of public service claim of administrative counterpart reflects whether the construction of service-oriented government falls into the reality of the rule of law from the angle of rights and obligations. But the realization of this right has many problems from theory, system to practice. Therefore, it is necessary to define the standard and category of public service claim of administrative counterpart step by step. In order to break through the limitation of traditional thinking of claim right, we need to carry out scientific and reasonable design according to legal theory, strengthen financial support and build e-government platform in practice. It can bring about the great transformation of public service system in our country, and guarantee the rights of administrative counterpart in the system.
