【摘要】：黨的十八大和十八屆三中全會(huì),提出了深化經(jīng)濟(jì)體制改革、政治體制改革、文化體制改革、社會(huì)體制改革、生態(tài)體制改革的要求和具體任務(wù)。同時(shí)，全面建成小康社會(huì)對(duì)依法治國(guó)提出了更高要求。對(duì)于公安機(jī)關(guān)來(lái)說(shuō)，特別是司法體制改革的日趨深入,政府的職能定位、行政管理工作正發(fā)生著根本性的轉(zhuǎn)變,管理型政府正逐步向服務(wù)型政府的轉(zhuǎn)變。隨著國(guó)家全面推進(jìn)科學(xué)立法、嚴(yán)格執(zhí)法、公正司法、全民守法，堅(jiān)持依法治國(guó)、依法執(zhí)政、依法行政的共同推進(jìn)，堅(jiān)持法治國(guó)家、法治政府、法治社會(huì)的一體建設(shè)，對(duì)公安機(jī)關(guān)交通管理部門(mén)的執(zhí)法能力和水平提出了新的更高的要求。交通違法行為是影響道路交通安全暢通有序的重要因素,對(duì)交通違法行為實(shí)施執(zhí)罰是交通管理工作的重要手段。因此，人民群眾對(duì)公安交警的執(zhí)法工作的要求也將越來(lái)越高。如何進(jìn)一步改進(jìn)和提升西安公安交警的執(zhí)法能力和水平,規(guī)范執(zhí)法行為,嚴(yán)格執(zhí)法程序,強(qiáng)化執(zhí)法監(jiān)督,集中整改人民群眾反映強(qiáng)烈的熱點(diǎn)、突出和難點(diǎn)問(wèn)題，特別是集中查處、整改一批執(zhí)法不公，執(zhí)法不嚴(yán)、執(zhí)法不作為，，甚至人情案、關(guān)系案、金錢(qián)案的問(wèn)題。不斷適應(yīng)新形式、新任務(wù)對(duì)公安機(jī)關(guān)提出的新要求、新挑戰(zhàn)。也是是擺在西安交警面前的一個(gè)很現(xiàn)實(shí)的課題。本文研究主要是以規(guī)范化為取向,深入的探討基于科學(xué)規(guī)范高效的管理新模式。提出了規(guī)范公安交警執(zhí)法的理論基礎(chǔ),并從西安交警執(zhí)法的實(shí)際工作出發(fā),歸納、總結(jié)、分析西安公安交警執(zhí)法傳統(tǒng)及現(xiàn)行管理模式在新形勢(shì)、新環(huán)境下面臨的問(wèn)題和不足,對(duì)路面交警在執(zhí)法中存在的問(wèn)題進(jìn)行了原因分析和探討。最后,結(jié)合西安交通管理工作的實(shí)際，對(duì)適合當(dāng)前現(xiàn)狀的交通管理執(zhí)法提出解決的對(duì)策和新模式。
[Abstract]:The 18th CPC Congress and the third Plenary session of the 18th CPC Central Committee put forward the requirements and specific tasks for deepening the reform of the economic system, the political system, the cultural system, the social system, and the ecological system. Building a well-off society in an all-round way has put forward higher requirements for governing the country according to law. For public security organs, especially the deepening of the reform of the judicial system, the orientation of the functions of the government and the work of administration are undergoing fundamental changes. The management-oriented government is gradually changing to a service-oriented government. As the country comprehensively promotes scientific legislation, strict law enforcement, fair administration of justice, law-abiding by the whole people, adherence to the rule of law, the rule of law, the common advancement of administration according to law, and a country ruled by law, The government ruled by law and the construction of a society under the rule of law have put forward new and higher requirements for the law enforcement ability and level of traffic management departments of public security organs. Traffic violations are important factors affecting road traffic safety, smooth and orderly. Enforcement of punishment for traffic violations is an important means of traffic management. Therefore, the people's demand for the law enforcement of traffic police will also be higher and higher. How to further improve and enhance the law enforcement capacity and level of Xi'an Public Security Traffic Police, Standardizing law enforcement actions, strictly enforcing law enforcement procedures, strengthening law enforcement supervision, centralizing rectification and rectification of people's strong hot spots, highlighting and difficult problems, in particular, centralizing investigation and punishment, rectifying a group of unfair law enforcement, lax enforcement of the law, and inaction in law enforcement, Even the human relations, relationship, and money cases. They are constantly adapting to new forms and new demands on public security organs put forward by new tasks. The new challenge is also a very realistic subject in front of Xi'an traffic police. This paper mainly focuses on standardization, deeply discusses the new management model based on scientific norms and high efficiency, and puts forward the theoretical basis of standardizing the law enforcement of traffic police in Xi'an. Based on the actual work of Xi'an Traffic Police, this paper sums up, summarizes and analyzes the problems and deficiencies faced by Xi'an Traffic Police in the new situation and new environment. This paper analyzes and discusses the problems existing in the law enforcement of road traffic police. Finally, combined with the practice of traffic management in Xi'an, the countermeasures and new models of traffic management law enforcement suitable for the present situation are put forward.
