流域水污染應(yīng)急管理協(xié)調(diào)機(jī)制法律問(wèn)題研究

【摘要】:水是人類賴以生存的基本的重要物質(zhì)之一,是社會(huì)經(jīng)濟(jì)發(fā)展的重要要素稟賦之一。我國(guó)水環(huán)境保護(hù)面臨的突出問(wèn)題就是缺水;同時(shí)它也是學(xué)界一項(xiàng)引人關(guān)注的研究課題,人們非常關(guān)注流域水污染的預(yù)防和治理。多樣性和區(qū)域性的污染、水污染的完整性,污染特性的差異,只有充分考慮這些特點(diǎn)的預(yù)防,具體問(wèn)題具體分析。流域治理是流域水污染防治基本理念,在防治過(guò)程中要充分考慮流域的整體性,要和以前的管理方式區(qū)別開來(lái),其優(yōu)越性是區(qū)域管理無(wú)法企及的。 本文采用的方法:語(yǔ)義分析論證,比較分析和跨學(xué)科的分析。在形式的水污染控制法和流域水污染應(yīng)急管理機(jī)制的基礎(chǔ)上,借鑒國(guó)外先進(jìn)的立法制度,管理制度和相關(guān)的法律制度三個(gè)方面。具體內(nèi)容如下:首先,,健全流域水污染防治法律體系,制定相關(guān)法律統(tǒng)一規(guī)范全國(guó)的流域水污染防治;其次,建立中央行政流域管理預(yù)防管理系統(tǒng),設(shè)置國(guó)家流域水資源保護(hù)委員會(huì),主要流域水資源環(huán)境保護(hù)的整體管理和調(diào)整,設(shè)置流域水資源保護(hù)局和具體的流域水資源保護(hù)委員會(huì),統(tǒng)一管理、合并開發(fā)利用與污染控制,流域水資源保護(hù)委員會(huì)的管轄,流域水污染控制系統(tǒng)的新思路,提出了流域生態(tài)補(bǔ)償制度①與地方系統(tǒng)完美結(jié)合的建設(shè)意見。 目前,有很多關(guān)于流域水污染應(yīng)急管理方面的法律,卻沒(méi)有全面而系統(tǒng)的對(duì)其進(jìn)行規(guī)定,只是部分散見于其他規(guī)定之中,必須通過(guò)立法進(jìn)行完善。
[Abstract]:Water is one of the basic important materials for human survival and one of the important factor endowments for social and economic development. People are very concerned about the prevention and treatment of water pollution in watersheds. Diversity and regional pollution, the integrity of water pollution, differences in pollution characteristics, and the prevention of these characteristics must be taken fully into account. Watershed management is the basic concept of watershed water pollution control. In the process of prevention and control, the integrity of the basin should be fully considered, which should be distinguished from the previous management methods, and its superiority is beyond the reach of regional management. The methods used in this paper are semantic analysis, comparative analysis and interdisciplinary analysis. On the basis of the formal water pollution control method and the watershed water pollution emergency management mechanism, the advanced foreign legislative system is used for reference. Three aspects of management system and related legal system. The specific contents are as follows: first, improve the legal system of river basin water pollution prevention and control, formulate relevant laws to unify and standardize the basin water pollution prevention and control in the whole country; secondly, To establish a central administrative watershed management prevention and management system, to set up the State Watershed Water Resources Protection Committee, the overall management and adjustment of the environmental protection of water resources in major watersheds, and to set up a watershed water resources protection bureau and a specific watershed water resources protection committee. Unified management, combined exploitation and utilization and pollution control, jurisdiction of watershed water resources protection committee, new ideas of watershed water pollution control system are put forward, and the construction opinions of perfect combination of watershed ecological compensation system and local system are put forward. At present, there are many laws on water pollution emergency management, but there are no comprehensive and systematic regulations on them, only some of them are scattered in other regulations, which must be improved through legislation.
