【摘要】：《體育法》修改是當(dāng)前我國體育法治建設(shè)的一項重要任務(wù)。文章運用文獻研究、比較分析等方法對加拿大的兩部體育法——1943年《國家身體健康法》和1961年《健康與業(yè)余體育法》進行了研究,探討了兩部法律的立法背景、法律文本內(nèi)容,并對兩部法律進行了評析。研究認(rèn)為,《國家身體健康法》的實施效果并不如人意,但卻開啟了加拿大體育立法時代;《健康與業(yè)余體育法》則標(biāo)志著加拿大聯(lián)邦政府正式從國家層面來推動體育的發(fā)展,并成為20世紀(jì)后半葉加拿大的主要體育法律,確立了政府促進體育發(fā)展的基本制度。就立法經(jīng)驗而言,根據(jù)社會發(fā)展的需求進行立法和修法、政府合理的介入體育發(fā)展、明確體育管理機構(gòu)的構(gòu)成和權(quán)責(zé)、建立體育發(fā)展的財政支持制度、對關(guān)鍵性概念進行界定、建立體育法實施評估制度等是對我國體育立法和修法最有借鑒意義的經(jīng)驗。
[Abstract]:The amendment of the Sports Law is an important task in the construction of sports rule of law in China. By means of literature research and comparative analysis, this paper studies two sports laws in Canada, the National physical Health Act of 1943 and the Health and Amateur Sports Act of 1961, and probes into the legislative background of the two laws. The content of the legal text and the evaluation of the two laws. The study concluded that the implementation of the National physical Health Act was not satisfactory, but it opened an era of Canadian sports legislation, while the Health and Amateur Sports Act marked the formal promotion of sports development at the national level by the Canadian Federal Government. It became the main sports law of Canada in the second half of the 20th century, and established the basic system of the government to promote the development of sports. As far as the legislative experience is concerned, according to the needs of social development, the government should legislate and amend the law, the government should intervene in the sports development reasonably, make clear the constitution and responsibility of the sports management organization, establish the financial support system of the sports development, and define the key concepts. Establishing the evaluation system of sports law is the most significant experience for our country's sports legislation and law revision.
