【摘要】：首次在法律中規(guī)定非強制手段是《行政強制法》的貢獻。非強制手段法律化是行政民主化和公私利益均衡化的產(chǎn)物,它的出現(xiàn)改變了我國行政行為制度體系中強制行為獨攬?zhí)煜碌木置妗１M管《行政強制法》規(guī)定了催告履行和協(xié)議執(zhí)行兩種非強制手段,但對于非強制手段而言,其制度供給無疑是不夠的;必須跳出《行政強制法》的框架并結(jié)合非強制行政的制度化實踐,才能構(gòu)建起符合非強制手段屬性的規(guī)范體系。
[Abstract]:It is the contribution of the Administrative compulsory Law to stipulate the non-coercive means in the law for the first time. The legalization of non-coercive means is the product of the democratization of administration and the equalization of public and private interests. Its appearance has changed the situation that the compulsory act dominates the world in the system of administrative behavior in our country. Although the "Administrative compulsory Law" stipulates two kinds of non-coercive means: the enforcement of the notice and the execution of the agreement, the supply of the system is no doubt insufficient for the non-coercive means. Only by jumping out of the framework of "Administrative compulsory Law" and combining with the institutionalized practice of non-compulsory administration, can we construct a standard system which accords with the attribute of non-coercive means.
