【摘要】：從近幾年發(fā)生的案例來看,公安現場執(zhí)法似有陷入困境之虞。公安執(zhí)法規(guī)范化建設所期待的"規(guī)則之治"未能如期而至,關于這個問題,"權力規(guī)制法治"范式有很高的解釋力。要解決公安現場執(zhí)法難題,須在增配公安部門權力資源和減縮公安事權兩個方面著手,其中確保警察充分運用自由裁量權和分化剝離非警務活動是突破口。應當將包括公安現場執(zhí)法工作在內的公安工作置于法治建設視域之中考量,達成新的發(fā)展共識。
[Abstract]:From the case of recent years, public security scene law enforcement seems to be in trouble. The "rule of law", which is expected by the standardization construction of public security law enforcement, has not arrived as expected. On this issue, the paradigm of "power regulation and rule by law" has a high explanatory power. In order to solve the difficult problem of public security field law enforcement, it is necessary to increase the power resources of public security department and to reduce the power of public security department, among which, it is the breakthrough point to ensure the police to make full use of discretion and to separate and peel off the non-policing activities. The public security work, including law enforcement on the spot, should be considered from the perspective of the construction of the rule of law and a new consensus of development should be reached.
