我國(guó)草原行政處罰裁量基準(zhǔn)制定的相關(guān)問(wèn)題研究

【摘要】:草原行政處罰裁量基準(zhǔn)的目的在于限制草原行政執(zhí)法機(jī)關(guān)濫用行政處罰裁量權(quán),以規(guī)范草原監(jiān)督管理中的行政處罰行為,保護(hù)行政相對(duì)人的權(quán)益。本文從草原行政處罰裁量基準(zhǔn)的基本原理和制定現(xiàn)狀出發(fā),對(duì)草原行政處罰裁量基準(zhǔn)制定過(guò)程的相關(guān)問(wèn)題進(jìn)行研究。 本文第一部分界定了草原行政處罰裁量基準(zhǔn)的概念,并將其定性為一種具有規(guī)則性質(zhì)的行政自制規(guī)范,分析了其特點(diǎn),進(jìn)而闡述了其所具有的規(guī)制草原行政處罰裁量權(quán)、提高草原行政執(zhí)法的效率、為草原行政主管機(jī)關(guān)及執(zhí)法人員提供自我約束依據(jù)、為草原行政主管機(jī)關(guān)的行政處罰裁量行為提供可供說(shuō)明的理由等基本功能。 本文第二部分在梳理了我國(guó)草原行政處罰裁量基準(zhǔn)制定現(xiàn)狀的基礎(chǔ)上,從制定主體混亂、考量因素不完善、制定程序不規(guī)范三個(gè)方面,分析了草原行政處罰裁量基準(zhǔn)制定過(guò)程中存在的問(wèn)題。 本文第三部分分別針對(duì)草原行政處罰裁量基準(zhǔn)制定過(guò)程中存在的具體問(wèn)題,提出完善建議。首先,將草原行政處罰裁量基準(zhǔn)的制定主體明確為省級(jí)草原行政主管機(jī)關(guān),并剖析了市級(jí)、縣級(jí)草原行政主管機(jī)關(guān)不能作為草原行政處罰裁量基準(zhǔn)制定主體的原因;其次,將制定草原行政處罰裁量基準(zhǔn)的考量因素區(qū)分為判斷行為輕重的考量因素和決定具體量罰的考量因素,針對(duì)兩類(lèi)考量因素所存在的不同問(wèn)題,提出不同的細(xì)化建議,試圖健全制定草原行政處罰裁量基準(zhǔn)的考量因素體系。最后,依據(jù)《規(guī)章制定程序條例》的規(guī)定,對(duì)草原行政處罰裁量基準(zhǔn)的制定程序進(jìn)行理論上的完善。
[Abstract]:The purpose of the administrative penalty discretion standard in grassland is to restrict the administrative law enforcement agencies from abusing the administrative penalty discretion in order to standardize the administrative punishment in the grassland supervision and management and to protect the rights and interests of the administrative counterpart. Based on the basic principle and current situation of administrative penalty discretion benchmark in grassland, this paper studies the relevant problems in the process of making administrative penalty discretion benchmark in grassland. The first part of this paper defines the concept of administrative penalty discretion benchmark of grassland, and characterizes it as a kind of administrative self-made norm with the nature of rules, analyzes its characteristics, and then expounds its discretion to regulate administrative punishment in grassland. To improve the efficiency of grassland administrative law enforcement, to provide self-restraint basis for grassland administrative authorities and law enforcement personnel, and to provide reasons for explaining administrative punishment discretion of grassland administrative authorities. In the second part of this paper, on the basis of combing the current situation of the establishment of the administrative penalty discretion benchmark in the grassland of our country, there are three aspects: confusion in the formulation of the main body, imperfect consideration factors, non-standard formulation procedure. This paper analyzes the problems existing in the process of formulating the discretion standard of grassland administrative penalty. In the third part of this paper, the author puts forward some suggestions to improve the administrative penalty of grassland. First of all, the main body of the grassland administrative penalty discretion standard is defined as the provincial grassland administrative authority, and analyzes the reasons why the municipal and county level grassland administrative authority can not be the main body of the grassland administrative penalty discretion benchmark; secondly, According to the different problems existing in the two kinds of factors, this paper puts forward different detailed suggestions, which can be divided into the factors of judging the severity of the behavior and the factors determining the specific penalty. This paper tries to perfect the consideration factor system of setting up the administrative penalty discretion standard of grassland. Finally, according to the regulations of the rules and regulations, this paper makes a theoretical improvement on the procedure of formulating the administrative penalty discretion standard of the grassland.
