【摘要】：軟法的興起與國家和社會的發(fā)展密不可分,當(dāng)傳統(tǒng)法治范式不能滿足社會需求之時,軟法卻能在第一時間內(nèi)對新興社會領(lǐng)域做出回應(yīng)。國家治理現(xiàn)代化作為一項復(fù)雜的政治工程和政治實踐,離不開軟法精神及軟法治理。在國家治理現(xiàn)代化的體系建構(gòu)中,軟法精神應(yīng)該從文化維度、內(nèi)生維度、外在維度三個層面上得以呈現(xiàn)。通過軟法治理,能夠整合三重動力,凸顯中國共產(chǎn)黨的核心領(lǐng)導(dǎo)作用,激發(fā)踐行社會主義核心價值觀的政治熱情,彰顯改革與創(chuàng)新的政治勇氣。在軟法參與國家治理的具體機(jī)制上,可以從立法、司法、執(zhí)法等多個層面進(jìn)行體系設(shè)計與制度創(chuàng)新。
[Abstract]:The rise of soft law is inextricably related to the development of the country and society. When the traditional paradigm of rule of law cannot meet the needs of society, soft law can respond to the emerging social field in the first place. Modernization of state governance as a complex political project and political practice, can not be separated from the spirit of soft law and soft law governance. In the system construction of the modernization of national governance, the spirit of soft law should be presented from three aspects: cultural dimension, endogenous dimension and external dimension. By means of soft law governance, we can integrate the three driving forces, highlight the core leadership role of the Communist Party of China, stimulate the political enthusiasm to practice the socialist core values, and demonstrate the political courage of reform and innovation. On the specific mechanism of soft law participating in national governance, the system design and system innovation can be carried out from many aspects such as legislation, judicature, law enforcement and so on.
