【摘要】：在我國(guó),集體成員是集體所有權(quán)的終極權(quán)利主體,重視集體成員權(quán)乃屬邏輯必然。集體成員權(quán)事關(guān)集體成員生存利益和農(nóng)村社會(huì)穩(wěn)定,在集體建設(shè)用地使用權(quán)出讓中必須重視集體成員權(quán)的實(shí)現(xiàn)。做好集體建設(shè)用地使用權(quán)出讓中集體成員權(quán)的權(quán)利體系設(shè)計(jì)應(yīng)該以自益權(quán)和共益權(quán)為基本類型,豐富集體成員權(quán)的體系。應(yīng)該通過(guò)集體建設(shè)用地使用權(quán)出讓過(guò)程中集體成員權(quán)體系的私權(quán)確認(rèn)和保障實(shí)現(xiàn)對(duì)村社權(quán)力和公權(quán)力的合理制約,健全集體成員權(quán)的行使和保障機(jī)制,切實(shí)保障集體成員經(jīng)濟(jì)利益和民主權(quán)利的實(shí)現(xiàn)。
[Abstract]:In our country, collective member is the ultimate right subject of collective ownership, it is logical necessity to attach importance to collective member right. The rights of collective members are related to the survival interests of collective members and the stability of rural society. We must pay attention to the realization of collective members' rights in the transfer of the right to use collective construction land. The right system of collective members in the transfer of collective construction land use rights should be designed according to the basic types of self-interest right and common benefit right to enrich the system of collective members' right. We should confirm and guarantee the private rights of the collective members' right system in the process of the transfer of the collective construction land use right to realize the reasonable restriction on the village community power and the public power, and perfect the exercise and protection mechanism of the collective member's right. We will ensure the realization of collective members' economic interests and democratic rights.
