社會(huì)信用法律制度研究

【摘要】:社會(huì)信用是保障市場(chǎng)經(jīng)濟(jì)順利開展的基本前提,是維系市場(chǎng)交易的基本鏈條。作為一種能夠帶來(lái)經(jīng)濟(jì)效益的社會(huì)資本,,信用水平的高低決定著市場(chǎng)交易成本的多寡,對(duì)于增進(jìn)全社會(huì)的經(jīng)濟(jì)利益,實(shí)現(xiàn)市場(chǎng)經(jīng)濟(jì)的良性循環(huán)具有重要作用。目前,中國(guó)的社會(huì)總體信任度已經(jīng)跌破60分的信任底線,信用問(wèn)題是中國(guó)現(xiàn)實(shí)發(fā)展中所面臨的重大問(wèn)題,由于社會(huì)的轉(zhuǎn)型,人們逐漸脫離的原來(lái)的熟人社會(huì)形態(tài),原有的信任格局被改變,同時(shí)社會(huì)轉(zhuǎn)型中市場(chǎng)經(jīng)濟(jì)秩序不完善,法律法規(guī)不健全或得不到很好的執(zhí)行,都加劇了社會(huì)信任度的下滑。 信用的維系主要依靠人們內(nèi)心的道德約束、市場(chǎng)的自律性調(diào)節(jié)和法律的監(jiān)管。單純依靠道德自律、市場(chǎng)自發(fā)調(diào)節(jié)來(lái)難以達(dá)到讓社會(huì)成員都遵守信用、社會(huì)信用水平整體提高的理想狀態(tài)。要提高社會(huì)信用水平必須對(duì)社會(huì)信用與社會(huì)信用法律制度的一般特性進(jìn)行分析,并借鑒發(fā)達(dá)國(guó)家社會(huì)信用法律制度建設(shè)的經(jīng)驗(yàn),從個(gè)人信用的法律制度建設(shè)和個(gè)人信用體系建設(shè)倆方面來(lái)完善個(gè)人信用法律制度,從完善企業(yè)信用制度立法、健全企業(yè)信用懲戒機(jī)制和建立內(nèi)部信用管理制度三方面對(duì)企業(yè)信用法律制度加以完善,從政府信用的法律制度建設(shè)和社會(huì)信用體系監(jiān)管等方面使政府信用法律制度更加趨于完備,以求從制度層面來(lái)解決社會(huì)信用問(wèn)題,從制度上、法律上和管理機(jī)制上降低信任風(fēng)險(xiǎn),重建社會(huì)信用。
[Abstract]:Social credit is the basic premise to ensure the smooth development of market economy and the basic chain of maintaining market transactions. As a kind of social capital which can bring economic benefits, the level of credit determines the amount of transaction cost in the market, which plays an important role in promoting the economic interests of the whole society and realizing the virtuous circle of market economy. At present, the overall level of social trust in China has fallen below the bottom line of 60 points of trust, and the issue of credit is a major problem facing the development of China in reality. As a result of the social transformation, people gradually break away from the original social form of acquaintance. The original trust pattern has been changed, at the same time, the market economy order is not perfect in the social transformation, and the laws and regulations are not perfect or can not be carried out well, which aggravates the decline of the social trust degree. The maintenance of credit mainly depends on people's inner moral constraints, market self-discipline regulation and legal supervision. Relying solely on moral self-discipline and self-regulation of the market, it is difficult to achieve the ideal state that the members of the society abide by the credit and improve the level of the social credit as a whole. In order to improve the level of social credit, we must analyze the general characteristics of social credit and social credit legal system, and draw lessons from the experience of the construction of social credit legal system in developed countries. We should perfect the legal system of personal credit from two aspects: the construction of legal system of personal credit and the construction of personal credit system, and perfect the legislation of enterprise credit system. Perfect the enterprise credit punishment mechanism and establish the internal credit management system to perfect the enterprise credit legal system. From the aspects of the construction of the legal system of government credit and the supervision of social credit system, the legal system of government credit tends to be more perfect, in order to solve the problem of social credit from the institutional level, and from the institutional point of view, Law and management mechanism to reduce the risk of trust, rebuild social credit.
