【摘要】：網(wǎng)絡(luò)文化是基于網(wǎng)絡(luò)行為而產(chǎn)生的精神現(xiàn)象,包括與網(wǎng)絡(luò)有關(guān)的行為習(xí)慣、心理狀態(tài)、思維方式、知識(shí)結(jié)構(gòu)、道德評(píng)價(jià)、價(jià)值觀念、審美情趣等。它是一種虛擬的文化時(shí)空,它的范圍空前廣闊而開放。網(wǎng)絡(luò)文化的出現(xiàn)引來了一系列人類文化發(fā)展中從未遇到的新問題、新挑戰(zhàn)和文化研究的新空間。隨著網(wǎng)絡(luò)文化的逐漸形成,網(wǎng)絡(luò)文化中存在的問題已經(jīng)開始初現(xiàn)端倪。分析網(wǎng)絡(luò)文化中存在的問題,研究現(xiàn)有和應(yīng)有的網(wǎng)絡(luò)文化是本研究的主要途徑;用法制指引和規(guī)范網(wǎng)絡(luò)文化建設(shè),用先進(jìn)的網(wǎng)絡(luò)文化引領(lǐng)網(wǎng)絡(luò)的建設(shè)與發(fā)展,是本研究的主要思路。本文分為五個(gè)部分進(jìn)行論述:第一部分,是本文的緒論,闡述了本選題的研究背景、研究現(xiàn)狀及研究方法和創(chuàng)新點(diǎn)。第二部分,介紹相關(guān)概念。包括:網(wǎng)絡(luò)文化的概念、網(wǎng)絡(luò)文化的主要特征、網(wǎng)絡(luò)文化的功能和意義及我國(guó)網(wǎng)絡(luò)文化建設(shè)法制保障的內(nèi)涵。第三部分,論述我國(guó)網(wǎng)絡(luò)文化建設(shè)的現(xiàn)狀及主要問題。從社交網(wǎng)絡(luò)文化、電子商務(wù)文化、言論自由、網(wǎng)絡(luò)安全文化幾方面對(duì)我國(guó)網(wǎng)絡(luò)文化建設(shè)的現(xiàn)狀進(jìn)行了梳理。接下來,針對(duì)我國(guó)網(wǎng)絡(luò)文化中存在犬儒現(xiàn)象,電子商務(wù)文化中的非誠(chéng)信問題,網(wǎng)絡(luò)版權(quán)文化的侵權(quán)問題,敵對(duì)勢(shì)力利用網(wǎng)絡(luò)的文化滲透幾方面進(jìn)行分析。第四部分,論述我國(guó)網(wǎng)絡(luò)文化建設(shè)的法制概況及主要問題。從我國(guó)互聯(lián)網(wǎng)法制建設(shè)的發(fā)展歷程到我國(guó)網(wǎng)絡(luò)文化建設(shè)的法制概況,對(duì)我國(guó)互聯(lián)網(wǎng)發(fā)展的脈絡(luò)進(jìn)行了梳理,并指出我國(guó)網(wǎng)絡(luò)文化建設(shè)的法律制度問題。第五部分,從完善立法、加強(qiáng)執(zhí)法、加強(qiáng)網(wǎng)絡(luò)活動(dòng)主體的法制教育幾方面對(duì)我國(guó)網(wǎng)絡(luò)文化建設(shè)法制保障提出建議。認(rèn)為應(yīng)完善保護(hù)公民網(wǎng)絡(luò)信息安全和意志表達(dá)自由的法律制度;完善網(wǎng)絡(luò)監(jiān)督體系建設(shè)的法律制度。加強(qiáng)網(wǎng)絡(luò)執(zhí)法隊(duì)伍、執(zhí)法技術(shù)及行業(yè)自律建設(shè)。加強(qiáng)網(wǎng)絡(luò)活動(dòng)主體的懂法教育、守法教育和網(wǎng)絡(luò)安全教育。
[Abstract]:Network culture is a spiritual phenomenon based on network behavior, including network-related behavior habits, mental state, mode of thinking, knowledge structure, moral evaluation, values, aesthetic interests, and so on. It is a virtual cultural space-time, its scope is unprecedented wide and open. The emergence of network culture has led to a series of new problems, new challenges and new space for cultural research that have never been encountered in the development of human culture. With the gradual formation of the network culture, the problems in the network culture have begun to emerge. The main approach to this study is to analyze the problems existing in the network culture and to study the existing and proper network culture. The main idea of this study is to guide and standardize the construction of network culture by legal system and to guide the construction and development of network with advanced network culture. This paper is divided into five parts: the first part is the introduction of this paper, elaborated the research background, research status, research methods and innovation points. The second part introduces the related concepts. Including: the concept of network culture, the main characteristics of network culture, the function and significance of network culture and the connotation of legal protection of network culture construction in China. The third part, discusses our country network culture construction present situation and the main question. From the aspects of social network culture, e-commerce culture, freedom of speech and network security culture, this paper combs the status quo of the construction of network culture in China. Next, aiming at the cynicism phenomenon in the network culture of our country, the problem of non-honesty in the e-commerce culture, the infringement of the network copyright culture, and the penetration of the network culture by hostile forces. The fourth part, discusses our country network culture construction legal system general situation and the main question. From the development of China's Internet legal system construction to the legal situation of our country's network culture construction, this paper combs the context of our country's Internet development, and points out the legal system problems of our country's network culture construction. In the fifth part, from the aspects of perfecting the legislation, strengthening the law enforcement and strengthening the legal education of the main body of the network activities, some suggestions are put forward for the legal protection of the construction of the network culture. It is considered that the legal system of protecting citizens' network information security and freedom of expression of will should be perfected, and the legal system of constructing network supervision system should be perfected. Strengthen the network law enforcement team, law enforcement technology and industry self-discipline construction. We should strengthen the law-understanding education, the law-abiding education and the network security education of the main body of the network activity.
