【摘要】：文物是人類的共同文化遺產(chǎn)，文物保護(hù)需要社會各界力量共同參與。當(dāng)前，我國的文物保護(hù)任務(wù)主要是由國家承擔(dān)，但文物保護(hù)志愿者、社會捐贈、文物保護(hù)基金會、古建筑認(rèn)領(lǐng)、文物拍賣等私人力量參與文物保護(hù)的方式漸漸成為新趨勢。私人參與文物保護(hù)的研究成為我國行政法上研究的前沿課題，在私人參與文物保護(hù)的法定范圍、法律途徑、法律監(jiān)督等方面值得探討，，明確私人參與文物保護(hù)的法律地位，從而推進(jìn)我國文物保護(hù)的民營化進(jìn)程，引導(dǎo)和鼓勵更多私人力量參與文物保護(hù)，全方位確保文化遺產(chǎn)的安全。
[Abstract]:Cultural relics are the common cultural heritage of mankind. The protection of cultural relics requires the participation of all walks of life. At present, the task of cultural relics protection in our country is mainly undertaken by the state, but the way that the private forces participate in the protection of cultural relics is gradually becoming a new trend, such as volunteers for cultural relics protection, social donations, cultural relics protection foundations, ancient building claims, cultural relics auction and other private forces participating in cultural relics protection. The research on private participation in the protection of cultural relics has become a frontier subject in the administrative law of our country. The legal scope, legal channels and legal supervision of private participation in the protection of cultural relics are worthy of discussion, and the legal status of private participation in the protection of cultural relics is clearly defined. In order to promote the privatization of the protection of cultural relics, guide and encourage more private forces to participate in the protection of cultural relics, to ensure the safety of cultural heritage in an all-round way.
