交通警察權(quán)與其他行政權(quán)的關(guān)系及其實(shí)現(xiàn)——行政權(quán)譜系中的考察

【摘要】:處于行政權(quán)譜系的交通警察權(quán)與其他行政權(quán)的關(guān)系主要表現(xiàn)為職務(wù)協(xié)助,該定位不僅可為相關(guān)規(guī)章內(nèi)容不統(tǒng)一問題提供正當(dāng)性注解,而且基于法規(guī)范與法事實(shí)的錯(cuò)位以及城市治理的合作化訴求,也有其存在的正當(dāng)性基礎(chǔ)。兩者職務(wù)協(xié)助關(guān)系應(yīng)在雙重維度下展開:交通警察的協(xié)助行為應(yīng)具備基礎(chǔ)性條件、職權(quán)性要求、被動(dòng)性情勢(shì)、裁量性過程4要件;而其他行政主體協(xié)助行為的"基礎(chǔ)性條件"應(yīng)更為寬泛。對(duì)協(xié)助請(qǐng)求遭拒與協(xié)助行為責(zé)任承擔(dān),應(yīng)規(guī)定不同的救濟(jì)路徑。
[Abstract]:The relationship between traffic police power in administrative lineage and other administrative powers is mainly expressed as job assistance, and this position can not only provide justification for the inconsistency of relevant regulations and contents, but also provide an explanation of the legitimacy of the relationship between traffic police power and other administrative powers. Moreover, based on the dislocation of legal norms and legal facts, and the cooperative demand of urban governance, there is also a legitimate basis for its existence. The relationship between them should be carried out in the double dimensions: the traffic police should have the basic conditions, the duty requirement, the passive situation, the discretion process four elements; And the "basic condition" of other administrative subjects' assisting behavior should be broader. Different relief paths should be provided for the refusal of requests for assistance and responsibility for acts of assistance.
