【摘要】： 本文介紹了器官移植的概念、人類對人體器官移植的探索、發(fā)展和展望以及國內(nèi)外人體器官移植的現(xiàn)狀和相關(guān)立法狀況，闡述了人體器官移植相關(guān)立法的重要性和必要性；通過對人體器官移植涉及的民事和刑事法律問題的研究，闡明了人體器官移植相關(guān)立法的復(fù)雜性和涉及法律問題的廣泛性，并提出了我國人體器官移植相關(guān)立法的建議和對現(xiàn)有法律制度的完善措施。相信隨著生命科學(xué)技術(shù)、器官移植技術(shù)的發(fā)展和人們對死亡、人體器官移植觀念的改變，在政府、專家學(xué)者廣泛深入的研究和宣傳推動(dòng)下，一部立法技術(shù)先進(jìn)、內(nèi)容完善，，符合世界潮流和中國國情的人體器官移植相關(guān)法律一定會在不久的將來出臺。
[Abstract]:This paper introduces the concept of organ transplantation, the exploration, development and prospect of human body organ transplantation, the present situation and related legislation of human organ transplantation at home and abroad, and expounds the importance and necessity of legislation related to human organ transplantation. Through the study of the civil and criminal legal issues involved in human organ transplantation, this paper expounds the complexity of the legislation related to human organ transplantation and the universality of the legal issues involved. And put forward our country human organ transplant related legislation suggestion and to the existing legal system consummation measure. I believe that with the development of life science and technology, the development of organ transplantation technology and the change of people's concept of death and human organ transplantation, a piece of legislation is advanced in technology and perfect in content, driven by extensive and in-depth research and publicity by the government, experts and scholars, In line with the world trend and China's national conditions of human organ transplantation related laws will be introduced in the near future.
