【摘要】：土地是人類最基本的資源,耕地資源更是稀有資源,保護(hù)有限的土地資源就是保護(hù)人類的生命線。靖邊縣近年來隨著石油、天然氣和煤炭資源的大力開發(fā),經(jīng)濟(jì)飛速發(fā)展,城鎮(zhèn)化進(jìn)程加快,土地資源供需矛盾突出,土地監(jiān)察工作作用凸顯。但靖邊縣的土地執(zhí)法監(jiān)察工作存在著諸多的問題,陷入執(zhí)法難的困境。如何強(qiáng)化土地執(zhí)法監(jiān)察工作在保護(hù)土地方面的重要作用,促使土地執(zhí)法監(jiān)察工作走出執(zhí)法難的困境,是我們每個土地執(zhí)法監(jiān)察人員的責(zé)任與義務(wù),同時對于保護(hù)耕地、保證土地管理法律法規(guī)的順利實(shí)施,具有重要意義。本文運(yùn)用實(shí)地調(diào)查法,對靖邊縣土地執(zhí)法監(jiān)察的現(xiàn)狀進(jìn)行實(shí)地調(diào)查,從靖邊縣土地執(zhí)法監(jiān)察的機(jī)構(gòu)建設(shè)情況、監(jiān)察設(shè)備配置情況和監(jiān)察隊(duì)伍年齡構(gòu)成和學(xué)歷分布情況入手,通過分析2009-2014年靖邊縣土地違法行為的發(fā)現(xiàn)數(shù)量及涉及土地面積、違法案件查處數(shù)量及涉及土地面積、違法案件查處類型、違法案件主體,違法行為表現(xiàn)形式數(shù)量和面積等,總結(jié)得出靖邊縣各類土地違法主體在土地違法案件中具有的不同特點(diǎn),剖析造成違法用地高發(fā)的深層次原因,結(jié)合靖邊縣土地執(zhí)法監(jiān)察的實(shí)際,找出靖邊縣土地執(zhí)法監(jiān)察中存在著監(jiān)察機(jī)構(gòu)設(shè)置、監(jiān)察隊(duì)伍建設(shè)、監(jiān)察手段、宣傳力度和土地審批程序方面的問題,結(jié)合當(dāng)前靖邊縣的縣情和土地執(zhí)法監(jiān)察工作的實(shí)際及今后的發(fā)展趨勢,提出了從機(jī)構(gòu)建設(shè)、監(jiān)察隊(duì)伍素質(zhì)、執(zhí)法手段、監(jiān)察力度、聯(lián)動機(jī)制、開展宣傳和優(yōu)化審批程序等方面切合靖邊縣實(shí)際的對策和建議,從而實(shí)現(xiàn)靖邊縣土地執(zhí)法監(jiān)察工作的順利開展。
[Abstract]:Land is the most basic human resources, cultivated land resources are rare resources, the protection of limited land resources is the lifeline to protect human beings. With the development of oil, natural gas and coal resources in Jingbian County in recent years, the rapid development of economy, the acceleration of urbanization, the prominent contradiction between supply and demand of land resources, and the prominent role of land supervision. However, there are many problems in the supervision of land law enforcement in Jingbian County, and they fall into the dilemma of difficult enforcement. How to strengthen the important role of land enforcement supervision in the protection of land, and to promote land enforcement supervision out of the difficult predicament of law enforcement, is the responsibility and obligation of each of our land enforcement supervisors, and at the same time, it is the responsibility and obligation for the protection of cultivated land. It is of great significance to ensure the smooth implementation of land management laws and regulations. In this paper, the present situation of land law enforcement supervision in Jingbian County is investigated by the method of field investigation. It starts with the construction of land law enforcement supervision institutions in Jingbian County, the configuration of supervision equipment and the age composition of supervision team and the distribution of academic background. By analyzing the number and area of land violations found in Jingbian County from 2009 to 2014, the types of investigation and punishment of illegal cases, the subject of illegal cases, the number and area of illegal acts, and so on, This paper summarizes the different characteristics of various types of land illegal subjects in land illegal cases in Jingbian County, analyzes the deep-seated reasons for the high incidence of illegal land use, and combines the reality of land enforcement supervision in Jingbian County. Find out that there are some problems in the supervision of land law enforcement in Jingbian County, such as the establishment of supervision organization, the construction of supervision team, the means of supervision, the strength of propaganda and the procedure of land examination and approval. In the light of the present situation of Jingbian County and the actual situation of land law enforcement supervision and the development trend in the future, this paper puts forward the mechanism of organization construction, the quality of supervision team, the means of law enforcement, the intensity of supervision, and the linkage mechanism. In order to realize the smooth development of land law enforcement supervision work in Jingbian County, the propaganda and the optimization of examination and approval procedures should be carried out in accordance with the actual countermeasures and suggestions of Jingbian County.
