【摘要】：展會(huì)脫胎于“集市”這種古老的市場(chǎng)形態(tài),現(xiàn)在意義上的展會(huì)形成于17—19世紀(jì),迄今已走過了幾百年的時(shí)間。作為一個(gè)新興的經(jīng)濟(jì)增長(zhǎng)點(diǎn),展會(huì)日益成為世界各國(guó)和地區(qū)關(guān)注的焦點(diǎn)。為滿足展會(huì)迅速發(fā)展的需要,我國(guó)商務(wù)部、國(guó)家知識(shí)產(chǎn)權(quán)局、商標(biāo)局和國(guó)家版權(quán)局四部委聯(lián)合制定了《展會(huì)知識(shí)產(chǎn)權(quán)保護(hù)辦法》,于2006年3月1日正式實(shí)施。然而,由于自身存在的不足,導(dǎo)致該《辦法》在展會(huì)監(jiān)管方面起到的作用沒有達(dá)到人們的預(yù)期。 本文以展會(huì)中的法律問題及監(jiān)管機(jī)制為中心,從展會(huì)涉及的基本理論入手,運(yùn)用比較分析方法,結(jié)合德國(guó)、美國(guó)和中國(guó)香港等展會(huì)發(fā)達(dá)國(guó)家和地區(qū)的立法進(jìn)行闡述,揭示出我國(guó)目前立法存在的不足,提出了進(jìn)一步完善的方法與對(duì)策。全文除引言和結(jié)語外,共分為四個(gè)部分。 第一部分,展會(huì)相關(guān)基本理論分析。該部分主要從展會(huì)的概念,展會(huì)的特點(diǎn),展會(huì)涉及的主體進(jìn)行分析,并對(duì)展會(huì)根據(jù)不同的標(biāo)準(zhǔn)進(jìn)行分類。從而引出展會(huì)監(jiān)管的基本理論,以期達(dá)到展會(huì)監(jiān)管的法治目標(biāo)。 第二部分,對(duì)一些國(guó)家和地區(qū)展會(huì)監(jiān)管機(jī)制及立法、司法現(xiàn)狀的分析。該部分主要對(duì)展會(huì)發(fā)達(dá)國(guó)家和地區(qū)德國(guó)、美國(guó)和中國(guó)香港進(jìn)行分析,以期從其對(duì)比中,找到適合我國(guó)國(guó)情的展會(huì)監(jiān)管模式。 第三部分,我國(guó)展會(huì)的發(fā)展?fàn)顩r及存在的法律問題。該部分主要對(duì)我國(guó)展會(huì)的發(fā)展?fàn)顩r進(jìn)行簡(jiǎn)單分析,引出我國(guó)展會(huì)中存在的法律問題,并對(duì)這些法律問題出現(xiàn)的原因進(jìn)行歸納總結(jié)和我國(guó)監(jiān)管現(xiàn)狀的概括。 第四部分,完善我國(guó)展會(huì)監(jiān)管機(jī)制的建議。該部分主要從展會(huì)監(jiān)管的法理基礎(chǔ)進(jìn)行分析,從立法完善、制度建設(shè)和行業(yè)自治的角度提出完善我國(guó)展會(huì)監(jiān)管機(jī)制的建議。
[Abstract]:The exhibition was born out of the ancient market form of bazaar. It has been hundreds of years since it was formed in the 17-19 th century. As a new economic growth point, the exhibition has increasingly become the focus of attention of countries and regions around the world. In order to meet the needs of the rapid development of the exhibition, the Ministry of Commerce, the State intellectual property Office, the Trademark Office and the National copyright Bureau jointly formulated the "measures for the Protection of intellectual property Rights of the Exhibition", which was formally implemented on March 1, 2006. However, due to its own shortcomings, the regulatory role of the exhibition did not meet expectations. This paper focuses on the legal issues and regulatory mechanisms in the exhibition, starting with the basic theory involved in the exhibition, using the comparative analysis method and combining the legislation of developed countries and regions such as Germany, the United States and Hong Kong of China. This paper reveals the shortcomings of our country's current legislation, and puts forward some methods and countermeasures for further improvement. In addition to the introduction and conclusion, the full text is divided into four parts. The first part, the exhibition related basic theory analysis. This part mainly analyzes the concept of the exhibition, the characteristics of the exhibition, the main body involved in the exhibition, and classifies the exhibition according to different standards. It leads to the basic theory of exhibition supervision, in order to achieve the legal goal of exhibition supervision. The second part analyzes the supervision mechanism and legislation of exhibition in some countries and regions. This part mainly analyzes the developed countries and regions of the exhibition, Germany, the United States and Hong Kong, China. The third part, the development of China's exhibition and the existing legal problems. This part mainly analyzes the development of the exhibition in China, leads to the existing legal problems in the exhibition, and summarizes the reasons for these legal problems and the current situation of supervision in China. The fourth part, perfect our country exhibition supervision mechanism suggestion. This part mainly analyzes the legal basis of exhibition supervision, and puts forward some suggestions to perfect the supervision mechanism of exhibition in China from the angles of legislation perfection, system construction and industry autonomy.
