【摘要】：隨著我國(guó)社會(huì)主義政治經(jīng)濟(jì)體制改革的深入,社會(huì)結(jié)構(gòu)轉(zhuǎn)型不斷加快,非營(yíng)利組織得到了較快發(fā)展,在社會(huì)治理中的地位越來越重要,并發(fā)揮了不可替代的作用。但是近年來有關(guān)非營(yíng)利組織的負(fù)面新聞接連出現(xiàn),誠(chéng)信缺失已經(jīng)成為制約我國(guó)非營(yíng)利組織健康發(fā)展的瓶頸。研究非營(yíng)利組織誠(chéng)信缺失問題,對(duì)促進(jìn)非營(yíng)利組織發(fā)展、加快政府職能轉(zhuǎn)型乃至構(gòu)建和諧社會(huì)都有著極大的現(xiàn)實(shí)意義。本文通過文獻(xiàn)分析、理論研究、案例分析、制度研究以及比較研究等方法,對(duì)我國(guó)非營(yíng)利組織誠(chéng)信缺失問題進(jìn)行了研究,力圖為我國(guó)非營(yíng)利組織誠(chéng)信缺失的治理出謀劃策。本文開篇首先對(duì)研究背景、目的及意義、國(guó)內(nèi)外關(guān)于非營(yíng)利組織誠(chéng)信的研究現(xiàn)狀、內(nèi)容及方法進(jìn)行了闡述和鋪墊,接著對(duì)非營(yíng)利組織及非營(yíng)利組織誠(chéng)信等相關(guān)概念進(jìn)行了界定,引入治理理論、社會(huì)資本理論和信任理論對(duì)非營(yíng)利組織誠(chéng)信問題進(jìn)行了分析,為本研究提供了堅(jiān)實(shí)的理論基礎(chǔ)。結(jié)合典型案例分析,歸納出了目前我國(guó)非營(yíng)利組織誠(chéng)信缺失的一般表現(xiàn),進(jìn)而從法律環(huán)境、內(nèi)部治理和外部監(jiān)督三個(gè)方面探討了導(dǎo)致非營(yíng)利組織誠(chéng)信缺失的原因。為探求加強(qiáng)我國(guó)非營(yíng)利組織誠(chéng)信建設(shè)的有效路徑,本文介紹了美國(guó)、英國(guó)和德國(guó)非營(yíng)利組織誠(chéng)信建設(shè)的有益經(jīng)驗(yàn),在此基礎(chǔ)上,結(jié)合我國(guó)國(guó)情并針對(duì)前文原因分析提出了我國(guó)非營(yíng)利組織誠(chéng)信缺失的治理對(duì)策,主要體現(xiàn)在三個(gè)方面:首先,創(chuàng)造良好法律環(huán)境,建立健全相關(guān)法律法規(guī)體系,理順非營(yíng)利組織與政府之間的關(guān)系;其次,健全內(nèi)部治理機(jī)制,完善非營(yíng)利組織的理事會(huì)決策制度、績(jī)效考核制度、激勵(lì)制度和信息公開制度;最后,加強(qiáng)外部監(jiān)督力度,構(gòu)建包含政府、第三方評(píng)估機(jī)構(gòu)、公眾、媒體、行業(yè)自治組織多元主體在內(nèi)的全方位監(jiān)督體系。通過內(nèi)外綜合治理,不斷增強(qiáng)公眾對(duì)非營(yíng)利組織的信任,實(shí)現(xiàn)非營(yíng)利組織的誠(chéng)信經(jīng)營(yíng)。
[Abstract]:With the deepening of the reform of the socialist political and economic system in our country, the transformation of the social structure has been speeding up, and the non-profit organizations have been developing rapidly. The status of the non-profit organizations in social governance is becoming more and more important, and it has played an irreplaceable role. However, in recent years, the negative news about non-profit organizations has appeared one after another, and the lack of credibility has become the bottleneck restricting the healthy development of non-profit organizations in China. It is of great practical significance to study the lack of integrity of non-profit organizations to promote the development of non-profit organizations, to accelerate the transformation of government functions and even to build a harmonious society. Through literature analysis, theoretical research, case analysis, institutional research and comparative study, this paper studies the problem of the lack of integrity of non-profit organizations in China, and tries to give some suggestions for the governance of the lack of integrity of non-profit organizations in China. At the beginning of this paper, the background, purpose and significance of the research, the status quo, contents and methods of the research on the integrity of non-profit organizations are expounded, and then the related concepts, such as the integrity of non-profit organizations and non-profit organizations, are defined. This paper introduces governance theory, social capital theory and trust theory to analyze the integrity of non-profit organizations, which provides a solid theoretical basis for this study. Based on the analysis of typical cases, this paper sums up the general expression of the lack of integrity of non-profit organizations in our country, and then probes into the causes of the lack of integrity of non-profit organizations from three aspects: legal environment, internal governance and external supervision. In order to find an effective way to strengthen the integrity construction of non-profit organizations in China, this paper introduces the beneficial experiences of the United States, the United Kingdom and Germany in the construction of the integrity of non-profit organizations, on the basis of which, According to the situation of our country and the reasons above, this paper puts forward the countermeasures of the lack of integrity of non-profit organizations in our country, which are mainly reflected in three aspects: first, to create a good legal environment, and to establish and improve the relevant laws and regulations system. Straighten out the relationship between non-profit organizations and the government; secondly, improve the internal governance mechanism, improve the decision-making system of the Council of non-profit organizations, performance appraisal system, incentive system and information disclosure system; finally, strengthen external supervision, Construct the omnidirectional supervision system including the government, the third party appraisal organization, the public, the media, the industry autonomous organization multivariate main body. Through comprehensive management inside and outside, the trust of the public to NPO is strengthened continuously, and the good faith management of NPO is realized.
