【摘要】：當(dāng)今，隨著經(jīng)濟(jì)的發(fā)展、人權(quán)意識(shí)的逐步覺醒，人權(quán)與人權(quán)標(biāo)準(zhǔn)問題日益成為人們關(guān)注的熱點(diǎn)，西方資本主義國(guó)家通過人權(quán)外交推行其霸權(quán)主義和強(qiáng)權(quán)政治，，這是我們絕大數(shù)發(fā)展中國(guó)家所不能容忍的。結(jié)合目前國(guó)內(nèi)外人權(quán)研究現(xiàn)狀，本文旨在探索中國(guó)特色社會(huì)主義人權(quán)標(biāo)準(zhǔn)。首先，分析和概括資產(chǎn)階級(jí)人權(quán)概念和馬克思主義關(guān)于人權(quán)的概念以及目前存在的幾種人權(quán)標(biāo)準(zhǔn)形式，其次，在此基礎(chǔ)上揭露資本主義國(guó)家人權(quán)標(biāo)準(zhǔn)的本質(zhì)和特征，概括馬克思主義視域下人權(quán)標(biāo)準(zhǔn)的本質(zhì)和特征，通過分析和對(duì)比兩種社會(huì)制度下人權(quán)標(biāo)準(zhǔn)的差異，提出了構(gòu)建中國(guó)特色社會(huì)主義人權(quán)標(biāo)準(zhǔn)的必要性。最后，結(jié)合我國(guó)的基本國(guó)情與“和諧社會(huì)”理念的要求，探索出中國(guó)特色社會(huì)主義人權(quán)標(biāo)準(zhǔn)的彈性空間。構(gòu)建中國(guó)特色社會(huì)主義人權(quán)標(biāo)準(zhǔn)既可以有效地抵制資本主義國(guó)家人權(quán)攻擊又可以保障我國(guó)人權(quán)的實(shí)施，促進(jìn)我國(guó)人權(quán)事業(yè)的發(fā)展，具有很強(qiáng)的理論和現(xiàn)實(shí)意義。
[Abstract]:Nowadays, with the development of economy and the awakening of human rights consciousness, the issue of human rights and human rights standards has become a hot issue. Western capitalist countries promote their hegemonism and power politics through human rights diplomacy.This is something that a great number of developing countries cannot tolerate.Combined with the current situation of human rights research at home and abroad, this paper aims to explore the human rights standards of socialism with Chinese characteristics.Firstly, it analyzes and generalizes the concept of bourgeois human rights, the concept of human rights in Marxism and several existing forms of human rights standards. Secondly, on this basis, it exposes the nature and characteristics of human rights standards in capitalist countries.This paper summarizes the essence and characteristics of human rights standards from the perspective of Marxism, and puts forward the necessity of constructing socialist human rights standards with Chinese characteristics by analyzing and comparing the differences of human rights standards under the two social systems.Finally, according to the basic situation of our country and the requirement of the idea of "harmonious society", the flexible space of the human rights standard of socialism with Chinese characteristics is explored.Constructing the human rights standard of socialism with Chinese characteristics can effectively resist the attack of human rights in capitalist countries and guarantee the implementation of human rights in our country, and promote the development of human rights cause in China, which has strong theoretical and practical significance.
