憲政視域下依法治國與依法治黨的良性互動 〔中文摘要〕 當前，黨政關系已經成為推進政治體制改革、促進經濟社會科學和諧持續(xù)發(fā)展的一個不可回避的問題。本文從法治、憲政的視角，闡述了依法治國、依法治黨的基本概念及辯證關系，認為從憲政的互動規(guī)律和當代中國政治的基本特征可以看出，依法治黨與憲政密不可分、相輔相成，并且依法治國與依法治黨實現良性互動的關鍵是政黨政治的現代化水平。依法治國和依法治黨互動的現狀是從積極作用和存在問題展開的，積極作用主要體現在法治原則和憲政理念基本得到確立，，存在問題主要體現在與群眾的聯(lián)系和權力監(jiān)督制衡機制的健全等執(zhí)行方面。鑒于黨所處執(zhí)政地位的特殊性和當前甚至較長時期政治地位的不可替代性，筆者認為一方面黨要以高度的歷史責任感加強自身的現代化建設，以黨內民主帶動人民民主，用依法治黨保證依法治國，另一方面要用人民民主、法治建設的發(fā)展成果構建完善的權力監(jiān)督制約體系，使政黨與國家權力保持適當距離和良性互動，即通過依法治黨與依法治國的良性互動推進公民社會與政治國家的良性互動，促進人民幸福安康、祖國繁榮富強。 〔關健詞〕：憲政 依法治國 依法治黨 黨政關系 Study on the Constructive Mutual Influence between the Governance of the Government and Party by Law Abstract The issue involving the relationship between the party and government has been the critical and urgent problem needed to be solved in terms of the political relationship in socialist countries.The sound settlement of the problem plays a decisive role in the construction of the government party’s governance capability in socialist countries.It also has a great impact on the right and effective realization of the party’s and governmen
