【摘要】：Induct rial injury is an industrial society must face and attach importance to social problems,especially in the decades,China's rapid economic development,in this more than a dozen inductrial injury events appear constantly,our country of inductrial injury insurance legislation has been continual modification,on September 1,2014 issued new judicial interpretation of the supreme people's court of some issues about the trial of administrative cases of inductrial injury insurance regulations with the continuous development of social economy,all kinds of cases of inductrial injury happened.In dealing with all kinds of inductrial injury,a lot of problems emerge.Therefore,to carry out a series of inductrial injury insurance system tracking and perfect is necessary.Inductrial injury insurance system is the most important part of the system of industrial injury.Industrial injury,household is to determine the disability of laborer facts,so as to make the fit with inductrial injury,the behavior is important to the society by the injured workers insurance,at the request of the administrative department of the social insurance administrative department after receiving the request,according to the laws and regulations to make confirmation.As prophase and cornerstone of inductrial injury insurance system,system of industrial injury is an important step in inductrial injury insurance system,to the innovation and improvement of the legal system is to protect rights and interests of workers and build a better society has double significance in theory and practice.This article from the concept of industrial injury and the standard of industrial injury,contact Zhao Lishui case,analyze the current problems still exist in the current system of industrial injury,and combined with the related problems in this case some of their Suggestions,and hope for the improvement of the system of inductrial injury insurance.This paper includes three parts altogether.Of which the first part is based on Zhao Lishui v.Beijing haidian district social security bureau of industrial injury case introduction,case from the case summarized three controversial focus problems in this case.The second part analyzes the focus problem that induces:the about of the legitimacy of the decision process,second,the determination of of the facts of the decision;Third,about of the applicable law of the decision.Case himself several opinions are put forward.Last part of part of the system of our country industrial injury problems and corresponding Suggestions,which to offer corresponding help to improve the legal system of inductrial injury insurance,promote the socialist system of inductrial injury insurance system.
