【摘要】：在世界范圍內(nèi)的恐怖主義事件頻繁發(fā)生,給世界的穩(wěn)定已經(jīng)造成了很大的威脅。本文對于恐怖活動的法治防治對策進行了相關(guān)的研究。首先對恐怖主義犯罪的概念進行了概述,并對恐怖主義犯罪的起源與發(fā)展進行闡釋,闡明恐怖主義犯罪的特征包括:目的的政治性與宗教化、活動的組織性與跨國化、手段的暴力性與軍事化、對象的規(guī)模性與擴張化、類別的多樣性與復(fù)雜化、實施的突發(fā)性與秘密化�？植乐髁x犯罪的危害主要是危害國家安全與穩(wěn)定、導(dǎo)致社會動蕩、侵害公民生命、財產(chǎn)安全,并嚴重影響經(jīng)濟的發(fā)展。第二部分分析了我國反恐怖主義犯罪現(xiàn)狀與問題,主要有專門立法的調(diào)控與不足、執(zhí)法措施的功能與瓶頸、刑事司法的懲戒與困境,并分別對美國、俄羅斯、日本以及中東地區(qū)的反恐怖主義犯罪法律實踐進行了具體的分析�；�于以上分析,最后一部分提出了我國恐怖主義犯罪法律現(xiàn)狀與防治對策,主要的對策包括有完善反恐怖主義立法體系、加強國際間反恐怖主義合作、形成反恐怖主義犯罪的刑事應(yīng)對機制、綜合運用政治、外交、經(jīng)濟、科技等多種監(jiān)控舉措,為我國反恐怖主義防治的健全提供思路與幫助。
[Abstract]:The frequent occurrence of terrorist events in the world has caused a great threat to the stability of the world. This paper has carried on the related research on the countermeasures of the rule of law in the prevention and treatment of terrorist activities. Firstly, the concept of terrorist crime has been summarized. The origin and development of the crime of terrorism are explained. The characteristics of the crime of terrorism include: the political and religious ends, the organization and transnational of activities, the violence and militarization of means, the scale and expansion of objects. The diversity and complexity of the categories, the sudden and covert nature of the implementation. The harm of the terrorist crime is mainly to endanger the national security and stability, cause social unrest, infringe upon the lives of citizens and the safety of property. The second part analyzes the current situation and problems of anti-terrorist crime in China, including the regulation and insufficiency of special legislation, the function and bottleneck of law enforcement measures, the punishment and predicament of criminal justice, and respectively to the United States. Russia, Japan and the Middle East have made a concrete analysis of the legal practice of anti-terrorist crimes. Based on the above analysis, the last part has put forward the current legal situation and preventive measures of terrorism crimes in China. The main countermeasures include improving the legislative system against terrorism, strengthening international cooperation against terrorism, forming a criminal response mechanism to counter terrorist crimes, and comprehensively applying political, diplomatic, economic, scientific and technological and other monitoring measures. To our country anti-terrorism prevention and control to provide ideas and help.
