【摘要】：胎兒是人生命起始階段,它與自然人階段相互聯(lián)結(jié)、前后相繼,對(duì)胎兒利益進(jìn)行保護(hù),影響著未來(lái)的"人",同時(shí)也體現(xiàn)了對(duì)生命的敬畏與關(guān)懷�，F(xiàn)如今,大多數(shù)國(guó)家已經(jīng)逐漸重視胎兒利益的保護(hù)。隨著社會(huì)的發(fā)展,侵害胎兒利益的事件頻繁發(fā)生,而我國(guó)現(xiàn)行法律未明確規(guī)定胎兒利益的損害賠償請(qǐng)求權(quán),民事立法上的缺乏直接導(dǎo)致在民事司法實(shí)踐活動(dòng)中,司法審判人員對(duì)這類案件的處理會(huì)比較被動(dòng)。為了最大程度地維護(hù)胎兒的利益,胎兒享有損害賠償請(qǐng)求權(quán)就顯得尤為重要。本文主要對(duì)胎兒利益保護(hù)中的損害賠償進(jìn)行研究探討,共分為四部分:第一部分:我國(guó)胎兒利益保護(hù)中的損害賠償?shù)默F(xiàn)狀。該部分主要對(duì)我國(guó)胎兒利益損害賠償立法現(xiàn)狀與司法實(shí)踐進(jìn)行整理總結(jié)后,歸納出問(wèn)題。第二部分:胎兒利益保護(hù)中的損害賠償?shù)睦碚摶�礎(chǔ)。該部分首先對(duì)胎兒相關(guān)概念進(jìn)行界定分析,接著分析胎兒階段需保護(hù)的利益,之后梳理并分析我國(guó)胎兒利益保護(hù)的基礎(chǔ)學(xué)說(shuō),尋求胎兒利益保護(hù)的學(xué)說(shuō)基礎(chǔ),最后就胎兒享有損害賠償請(qǐng)求權(quán)的可行性和必要性進(jìn)行分析探討。第三部分:域外國(guó)家胎兒利益損害賠償制度的考察與借鑒。該部分主要對(duì)域外國(guó)家有關(guān)胎兒利益損害賠償相關(guān)制度進(jìn)行考察,指出我國(guó)應(yīng)借鑒域外優(yōu)秀司法實(shí)踐經(jīng)驗(yàn)及立法成果,實(shí)現(xiàn)對(duì)胎兒利益保護(hù)。第四部分:胎兒利益保護(hù)中的損害賠償?shù)膶?shí)現(xiàn)。該部分分類探討胎兒利益損害賠償請(qǐng)求權(quán)具體行使,包括其行使主體、時(shí)間以及損害賠償范圍。最后對(duì)胎兒利益損害賠償相關(guān)的特殊問(wèn)題,如父母能否為侵權(quán)人、父母的允諾及自甘冒險(xiǎn)行為能否為阻卻事由,以及胎兒利益與墮胎產(chǎn)生沖突的問(wèn)題進(jìn)行研究探討,希冀能更好地實(shí)現(xiàn)胎兒利益損害賠償請(qǐng)求權(quán),最大限度地維護(hù)胎兒的利益。
[Abstract]:Fetus is the initial stage of human life, it is connected with natural person stage, one after the other, protect the foetus' interests, affect the "human" in the future, at the same time, it embodies the reverence and concern for life. Most countries have paid more and more attention to the protection of fetal interests. With the development of society, infringing on fetal interests occurs frequently. However, the current law of our country has not clearly stipulated the right to claim damages for fetal interests. The lack of civil legislation directly leads to the relatively passive handling of such cases by judicial judges in civil judicial practice. In order to protect the interests of the fetus to the greatest extent, It is particularly important for the fetus to have the right to claim damages. It is divided into four parts: the first part: the present situation of damage compensation in the protection of fetal interests in our country. The second part: the theoretical basis of compensation for damage in the protection of fetal interests. This part defines and analyzes the related concepts of the fetus, and then analyzes the interests to be protected in the fetal stage. Then combing and analyzing the basic theory of the protection of fetal interests in our country, seeking the theoretical basis of protecting the interests of the fetus, Finally, the feasibility and necessity of fetal claim for damage compensation are analyzed and discussed. Part three: the investigation and reference of fetal interest compensation system in foreign countries. This part is mainly concerned with fetal interests in foreign countries. The relevant system of compensation for profit and damage shall be investigated, It is pointed out that our country should draw lessons from foreign excellent judicial practice and legislative achievements to realize the protection of fetal interests. Part 4th: the realization of compensation for damage in the protection of fetal interests. This part classifies and discusses the specific exercise of the right to claim for compensation for damage to fetal interests. Including its exercise subject, time and scope of compensation for damages. Finally, the special problems related to compensation for damage to the interests of the fetus, such as whether the parents can be infringers, whether the parents' promise and willingness to take risks can be the reasons for hindering, It is hoped that the right of claim for compensation for fetal interest damage can be better realized and the interests of fetus should be safeguarded to the maximum extent through research and discussion on the conflict between fetal interests and abortion.
