【摘要】：2015年11月30日,法國巴黎召開了《聯合國氣候變化框架公約》第21次締約方會議,經過12天的討論,《巴黎協議》最終獲得通過。該協議凝結了國際社會在應對全球氣候變化問題上最廣泛的共識,彰顯了國家利益和國際利益的均衡,是全球改善氣候變化問題進程的里程碑事件。文件共29條,包括應對全球氣候問題多層面和多角度的內容,尤其是共同但有區(qū)別責任原則的應用進一步得到了發(fā)展。該原則是國際環(huán)境法領域的基本原則,堅持共同但別責任原則是加強全球氣候變化進程中國際合作的堅實基礎。共同但有區(qū)別責任原則的發(fā)展過程就是該原則的應用過程,該原則產生的理論基礎和實踐基礎,決定了該原則必須順應時代的發(fā)展,因此持續(xù)關注該原則的發(fā)展變化是十分必要的。本文以應對全球氣候變化為背景,主要針對《巴黎協議》中共同但有區(qū)別責任原則的發(fā)展內容進行研究,分析共同但有區(qū)別責任原則的發(fā)展特點,對該原則在發(fā)展過程中我國面臨的挑戰(zhàn)進行總結,并提出相應對策。本文總共分為五個部分,按照引言、概述、理論基礎、新發(fā)展以及挑戰(zhàn)與應對的順序進行闡釋,具體內容設置如下:第一章引言部分,首先,從文章的選題著手,介紹共同但有區(qū)別責任原則得以發(fā)展的國際背景,探究該原則發(fā)展的現實意義,從論文研究的目的出發(fā)闡明研究價值;其次,介紹國內和國外有關共同但有區(qū)別責任原則的研究成果,為選題的研究提供方向,為論文的撰寫提供素材;最后,總結研究方法,歸納創(chuàng)新內容。第二章概述部分,分別從共同但有區(qū)別責任原則的內涵、歷史背景和歷史進程對該原則進行闡釋,關于該原則歷史進程的部分,結合相關的國際條約將該原則的歷史發(fā)展進程劃分為萌芽、確立、應用和發(fā)展四個階段,理順該原則的發(fā)展過程。第三章理論基礎部分,首先,共同但有區(qū)別責任原則產生的法學理論,從可持續(xù)發(fā)展理論、公共信托理論和污染者付費三個方面進行介紹;其次,對該原則產生的倫理學理論進行介紹,主要介紹非人類中心主義和環(huán)境正義理論對該原則產生的影響;最后,以外部經濟理論為研究中心,闡釋該原則產生的經濟學理論。第四章是介紹共同但有區(qū)別責任原則在《巴黎協議》中的新發(fā)展。首先,探究該原則在內涵上的豐富與發(fā)展;其次,以該原則的具體應用為著手點,探究該原則的發(fā)展內容,從國家自主貢獻模式、資金援助機制的操作性和行動和支助透明度的監(jiān)督機制為中心進行探究;再次,梳理共同但有區(qū)別責任原則的國際合作基礎,從合作依據、合作主體、合作利益和合作模式四個方面,探尋新的國際背景下的國際合作關系;最后,對共同但有區(qū)別責任原則的發(fā)展特點進行歸納,總結《巴黎協議》賦予該原則的新意義。第五章是我國在共同但有區(qū)別責任原則的發(fā)展過程中面臨的挑戰(zhàn)與應對。首先,強調我國在該原則發(fā)展過程中起到的作用;其次,從我國展開國際合作、推動國內經濟發(fā)展進程、資金機制和技術開發(fā)移轉機制四個方面分析我國所面對的挑戰(zhàn);最后,就上述挑戰(zhàn)提出相應的解決辦法。在當前形勢下,探討如何促進共同但有區(qū)別責任原則的積極發(fā)展,對于全球氣候變化的遏制和改善將有著十分重要的意義。
[Abstract]:In November 30, 2015, French Paris held a "United Nations Framework Convention on climate change on the twenty-first conference of the parties, after 12 days of discussion," Paris agreement ". The agreement is finally obtained by condensation of the international community the most widely in response to global climate change consensus on the issue, highlighting the national and international interests balance is the milepost the process of improving the events of the global climate change issues. A total of 29 documents, including the response to the global climate problem of multi-level and multi angle, especially the application of the principle of common but differentiated responsibilities has been further developed. The principle is the basic principle of International environmental law, adhere to the principle of common but not liability principle is a solid foundation for strengthening international cooperation in the process of global climate change. The third chapter is the theoretical foundation part, first of all, the common but differentiated responsibility law theory principle, from the theory of sustainable development, the theory of public trust and the polluter pays three aspects are introduced; secondly, the ethics theory on the principle of the introduction, mainly introduces the non anthropocentrism and environmental justice theory The impact of this principle; finally, based on the external economic theory as the research center of economics theory to explain this principle.
