【摘要】：實證研究表明,公安機關(guān)的刑事執(zhí)法質(zhì)量考評機制具有考評結(jié)果排名化,考評主體的內(nèi)部性與廣泛性,考評方式多元化,考評方法以定量為主、定性為輔,考評程序的行政化與有限性等特征。從效果層面分析,當(dāng)下的考評機制在較大程度上能夠發(fā)現(xiàn)刑事執(zhí)法中存在的問題,且具有相當(dāng)?shù)慕?jīng)濟(jì)性與可操作性,但存在的問題主要是"競賽式"考評意圖比較明顯,整體上法治化程度不高。這套機制的形成主要與全面推進(jìn)依法治國背景下嚴(yán)格執(zhí)法與公正司法的政策性要求、數(shù)字化時代公安執(zhí)法指標(biāo)化、流程化管理的技術(shù)要求及公安執(zhí)法應(yīng)對公眾訴求的策略要求有關(guān)。從長遠(yuǎn)發(fā)展的圖景觀之,考評機制應(yīng)實現(xiàn)"競賽式"考評向"法治化"考評轉(zhuǎn)變,即考評主體的外部性、考評指標(biāo)的"科學(xué)化"與考評問題的實體化。當(dāng)然,由于考評機制的科層化,指標(biāo)構(gòu)建標(biāo)準(zhǔn)科學(xué)化程度不高,指標(biāo)功能的有限性等問題,考評機制雖有助于提升但卻不能成為檢測公安機關(guān)刑事執(zhí)法質(zhì)量的唯一尺度,還需在考評之外結(jié)合其他機制共同完成。
[Abstract]:The empirical study shows that the evaluation mechanism of the quality of criminal law enforcement in public security organs has the rank of evaluation results, the internal and extensive nature of the subject, the diversity of the evaluation methods, the quantitative evaluation method and the qualitative evaluation method. The administrative and limited features of the evaluation procedure. From the aspect of effect, the current evaluation mechanism can find the problems in criminal law enforcement to a large extent, and has considerable economy and maneuverability, but the main problem is that the intention of "competitive" evaluation is obvious. On the whole, the degree of rule of law is not high. The formation of this set of mechanisms is mainly to promote the policy requirements of strict law enforcement and fair administration of justice under the background of governing the country according to law, and to target the law enforcement of public security in the digital age. The technical requirements of flow-based management and the strategic requirements of police law enforcement in response to public demands are related. From the perspective of long-term development, the evaluation mechanism should realize the transformation from "competition" to "rule by law", that is, the externality of the evaluation subject, the scientific evaluation index and the materialization of the evaluation problem. Of course, because of the stratification of the examination and evaluation mechanism, the scientific degree of the standard construction of the index, the limitation of the function of the index, and so on, the evaluation mechanism can not be the only yardstick for detecting the quality of the criminal law enforcement of the public security organs although it is helpful to promote it. It also needs to be completed in conjunction with other mechanisms in addition to the assessment.
