【摘要】：我國(guó)檢察體系奉行檢察一體原則,在法律定位下檢察權(quán)運(yùn)行的主體為人民檢察院,但在檢察實(shí)踐中檢察權(quán)具體運(yùn)行卻是由檢察官來(lái)完成。立法與實(shí)踐的悖反,使得檢察官獨(dú)立運(yùn)行檢察權(quán)成為當(dāng)下檢察權(quán)運(yùn)行機(jī)制改革的重點(diǎn)。通過(guò)域外檢察權(quán)運(yùn)行機(jī)制的考察,發(fā)現(xiàn)我國(guó)檢察官在行使檢察權(quán)中存在著檢察一體機(jī)制的不利制約、行政化管理模式的不當(dāng)干預(yù)和檢察官職務(wù)保障制度不完善等問(wèn)題。筆者擬對(duì)這些現(xiàn)存問(wèn)題進(jìn)行研究,探尋出適合我國(guó)檢察官獨(dú)立行使檢察權(quán)的正確路徑。
[Abstract]:China's procuratorial system pursues the principle of procuratorial integration, the legal orientation of procuratorial power under the main body for the people's Procuratorate, the prosecution in the procuratorial practice but the specific operation is right by the prosecutor to complete. The legislation and practice of the paradox of the prosecutor independent operation of procuratorial power has become the focus of the reform of procuratorial power operation mechanism through the investigation at the moment. The extraterritorial prosecutorial power operation mechanism, found that China's prosecutors had a negative restriction mechanism in the development of procuratorial procuratorial power, administrative management and improper intervention of the Prosecutor Office security system is not perfect. The author intends to study the problems, find out the right path for our country public procurator procuratorial the right to independence.
