司法視角下行政機(jī)關(guān)自行強(qiáng)制執(zhí)行程序之探究

【摘要】:對(duì)行政活動(dòng)的具體過程進(jìn)行有效控制以達(dá)到保障相對(duì)人合法權(quán)益的最重要手段就是建立并完善行政程序,行政程序具有規(guī)制行政自由裁量權(quán)濫用、遏制和消除腐敗的價(jià)值和功能,在現(xiàn)代行政權(quán)日益膨脹的背景下有著無可替代的“歷史使命”。行政強(qiáng)制執(zhí)行權(quán)賦予行政機(jī)關(guān),固然能夠提高行政效率,樹立行政機(jī)關(guān)的威信,但極可能引起行政權(quán)的肆意妄為。因此在行政機(jī)關(guān)自力行使行政強(qiáng)制領(lǐng)域必須建立嚴(yán)格的程序?qū)π姓䦶?qiáng)制執(zhí)行權(quán)進(jìn)行控制和約束。科學(xué)合理的程序制度,一方面能保障行政強(qiáng)制活動(dòng)的順利進(jìn)行,提高行政效率,達(dá)到行政管理目的;另一方面能保障行政強(qiáng)制執(zhí)行的合法性,確保行政相對(duì)方的合法權(quán)益不被侵犯。同時(shí),通過司法審查來進(jìn)一步規(guī)范和完善行政強(qiáng)制執(zhí)行程序,也是有效防止行政強(qiáng)制權(quán)專橫和泛濫的有效手段。 本文起始辯析和闡述了行政強(qiáng)制執(zhí)行的概念、權(quán)屬與方式,與其他兩種易混淆的行政行為進(jìn)行比較,以縱橫向?yàn)槊}絡(luò),確定了行政強(qiáng)制執(zhí)行的內(nèi)涵和外延。然后,進(jìn)一步分析了中外行政強(qiáng)制執(zhí)行運(yùn)行模式,從理論研究、法律規(guī)范、實(shí)踐運(yùn)作三個(gè)方面并結(jié)合相關(guān)案例剖析了我國行政強(qiáng)制執(zhí)行程序現(xiàn)狀,考察了德國、葡萄牙、日本對(duì)于行政強(qiáng)制執(zhí)行程序的規(guī)定,以期借他山之石對(duì)完善我國行政機(jī)關(guān)自力行使行政強(qiáng)制執(zhí)行程序帶來些許啟迪。在對(duì)行政強(qiáng)制執(zhí)行以及行政機(jī)關(guān)行使強(qiáng)制執(zhí)行程序進(jìn)行客觀了解及深入探討后,提出了現(xiàn)有法律框架下對(duì)行政強(qiáng)制執(zhí)行程序如何進(jìn)行司法審查這一本文關(guān)鍵問題,揭示了司法審查的不足,評(píng)述了救濟(jì)地位及階段,亮出了實(shí)質(zhì)性審查的觀點(diǎn),并以2011年6月30日第十一屆全國人民代表大會(huì)常務(wù)委員會(huì)第二十一次會(huì)議通過的《行政強(qiáng)制法》第四章為參考,對(duì)行政強(qiáng)制執(zhí)行中比較重要的若干程序問題進(jìn)行了充分陳述。最后圍繞意識(shí)、制度、操作、監(jiān)督等四個(gè)層面,就如何推進(jìn)行政強(qiáng)制執(zhí)行程序建設(shè)提出了若干思考和建議。本文的謀篇布局體現(xiàn)了理論與實(shí)踐相結(jié)合的特點(diǎn),穿叉于其中的案例帶有較強(qiáng)的實(shí)務(wù)性和易通性,在行政機(jī)關(guān)強(qiáng)制執(zhí)行程序日益受到關(guān)注的今天,是有一定現(xiàn)實(shí)指導(dǎo)意見的。
[Abstract]:The most important means to effectively control the specific process of administrative activities in order to protect the legitimate rights and interests of the counterpart is to establish and perfect the administrative procedure, which has the regulation of the abuse of administrative discretion. The value and function of containing and eliminating corruption has an irreplaceable "historical mission" under the background of the increasing expansion of modern administrative power. Administrative enforcement power bestows on administrative organs, which can certainly improve administrative efficiency. Establish the authority of the administrative organs. Therefore, in the field of administrative enforcement, we must establish strict procedures to control and restrain the administrative enforcement power, and scientific and reasonable procedural system. On the one hand, it can ensure the smooth progress of administrative compulsory activities, improve administrative efficiency, and achieve the purpose of administrative management; On the other hand, it can guarantee the legality of administrative enforcement and ensure that the legitimate rights and interests of the administrative counterpart are not infringed. At the same time, through judicial review to further standardize and improve the administrative enforcement procedures. It is also an effective means to prevent arbitrary and overrun administrative coercive power. At the beginning of this paper, the author analyzes and expounds the concept, ownership and mode of administrative enforcement, and compares it with the other two confusing administrative acts, taking the vertical and horizontal as the context. The connotation and extension of administrative enforcement are determined. Then, the operation mode of administrative enforcement at home and abroad is further analyzed, from the theoretical research, legal norms. Three aspects of practical operation and combined with relevant cases to analyze the current situation of administrative enforcement procedures in China, the investigation of Germany, Portugal, Japan for administrative enforcement procedures of the provisions. In order to take advantage of the stone of other mountains to improve our administrative organs to exercise administrative enforcement procedures on their own bring some inspiration. After the administrative enforcement and the administrative organs to exercise the enforcement procedures of objective understanding and in-depth discussion. This paper puts forward the key issue of how to conduct judicial review of administrative enforcement procedure under the existing legal framework, reveals the shortcomings of judicial review, comments on the relief status and stage, and shows the viewpoint of substantive review. In June 30th 2011, the standing Committee of the 11th National people's Congress passed the 21th session of the "Administrative compulsory Law" 4th as a reference. Some important procedural issues in the administrative enforcement are fully stated. Finally, the four levels of consciousness, system, operation and supervision are discussed. This paper puts forward some thoughts and suggestions on how to promote the construction of administrative compulsory execution procedure. The layout of this paper embodies the characteristics of combining theory with practice. Today, the executive enforcement procedure is paid more and more attention to, and has some practical guidance.
