【摘要】：在檢察權(quán)獨立的范圍上,受政治體制的影響,不同的國家和地區(qū)具有不同的模式。各異的檢察體制具有與本國或地區(qū)的政治體制相契合的特點,因而檢察權(quán)獨立的模式也各不相同,目前,主要有檢察院獨立模式和檢察院與檢察官同步獨立模式兩種。在我國大陸,檢察權(quán)獨立不是籠統(tǒng)的話語,它需要在檢察院獨立和檢察官獨立兩個層面上取得突破,其中,檢察院獨立是檢察官獨立的前提。改革過程中,要理順檢察機關與黨委和紀委的關系,同時需重新檢視檢察官獨立與行政職級待遇之間的錯位問題。
[Abstract]:In the scope of the independence of procuratorial power, different countries and regions have different modes under the influence of political system. Therefore, the modes of procuratorial power independence are different. At present, there are mainly two modes of procuratorate independence and procuratorate and procuratorate independence. In mainland China, procuratorial power independence is not a general statement. It needs to make a breakthrough at the two levels of the independence of the procuratorate and the independence of the procuratorate. Among them, the independence of the procuratorate is the prerequisite for the independence of the procuratorate. At the same time, it is necessary to re-examine the mismatch between the independence of prosecutors and the treatment of administrative rank.
