【摘要】：基層院內(nèi)設(shè)機(jī)構(gòu)如何進(jìn)行配置是任何檢察院如何更好地行使檢察職權(quán)的核心,作為檢察權(quán)配置的基本載體,基層院的內(nèi)設(shè)機(jī)構(gòu)設(shè)置應(yīng)當(dāng)與檢察職權(quán)的行使要做到相適應(yīng)。從目前檢察權(quán)的行使和檢察機(jī)構(gòu)運(yùn)行的情況看,我國(guó)基層院內(nèi)設(shè)機(jī)構(gòu)設(shè)置還存在一些不符合檢察工作科學(xué)發(fā)展的問(wèn)題。在明確檢察權(quán)的法律監(jiān)督屬性的前提下,針對(duì)我國(guó)基層檢察權(quán)配置和內(nèi)設(shè)機(jī)構(gòu)設(shè)置存在的問(wèn)題,梳理檢察權(quán)內(nèi)部配置的基本規(guī)律,科學(xué)定位我國(guó)基層檢察權(quán)能,以“五個(gè)分離”原則為指引,重新設(shè)置基層院內(nèi)設(shè)機(jī)構(gòu),并建立相應(yīng)運(yùn)行機(jī)制,從而實(shí)現(xiàn)優(yōu)化基層檢察權(quán)配置的目的是本文選題的意義所在。
[Abstract]:It is the core of how any procuratorate can better exercise the procuratorial power. As the basic carrier of the disposition of procuratorial power, the establishment of the internal organization of the grass-roots court should be adapted to the exercise of procuratorial power. From the current situation of the exercise of procuratorial power and the operation of procuratorial organs, there are still some problems which do not accord with the scientific development of procuratorial work. On the premise of clarifying the legal supervision attribute of procuratorial power, aiming at the problems existing in the allocation of procuratorial power and the establishment of internal organization, the basic law of internal disposition of procuratorial power is combed, and the ability of procuratorial power at grass-roots level in our country is scientifically positioned. Under the guidance of the principle of "five separations", the purpose of optimizing the allocation of procuratorial power at the grass-roots level is the significance of this paper.
