【摘要】："非法持有毒品罪"中很多方面涉及到刑法和民法學(xué)科交叉的問題,例如"持有"、"占有"等概念。因此要想對(duì)刑法罪名中的"非法持有毒品罪"進(jìn)行準(zhǔn)確地認(rèn)定,必須在刑民交叉領(lǐng)域?qū)�這些問題進(jìn)行嚴(yán)格的分析,以發(fā)現(xiàn)在民法領(lǐng)域可以為刑法領(lǐng)域借鑒的地方,以期在刑法的法律規(guī)范體系中,對(duì)"非法持有毒品罪"的"持有"行為達(dá)到一種更好的規(guī)制。本文以案例做為分析的引入,在對(duì)非法持有毒品罪進(jìn)行犯罪構(gòu)成分析之后,分兩部分對(duì)非法持有毒品罪中的"持有",進(jìn)行在刑法和民法交叉領(lǐng)域的比對(duì)研究。前一部分將刑法中"持有"與民法中"占有"相關(guān)規(guī)定進(jìn)行比對(duì)研究,后一部分對(duì)非法持有毒品罪中"持有"規(guī)定進(jìn)行了嚴(yán)格地辨析。
[Abstract]:Many aspects of the crime of illegal possession of drugs involve the intersection of criminal law and civil law, such as the concepts of possession and possession. Therefore, in order to accurately identify the crime of "illegal possession of drugs" in the criminal law, we must make a strict analysis of these problems in the intersecting field of criminal law, in order to find out what can be used for reference in the field of civil law. In order to achieve a better regulation on the "possession" of "illegal possession of drugs" in the legal normative system of criminal law. This article takes the case as the analysis introduction, after carries on the criminal constitution analysis to the illegal drug possession crime, divides into two parts to "hold" in the illegal drug possession crime, carries on the comparative research in the criminal law and the civil law intersection domain. The first part compares the relevant provisions of "possession" in criminal law with "possession" in civil law, while the latter part strictly discriminates and analyzes the provisions of "possession" in the crime of illegal possession of drugs.
