【摘要】：《刑法》第90條確立了刑法變通實(shí)施權(quán),學(xué)界對(duì)該權(quán)利存在誤讀,主要原因在于對(duì)該權(quán)利性質(zhì)認(rèn)識(shí)不清。《刑法》第90條是立法者綜合考慮我國(guó)少數(shù)民族社會(huì)發(fā)展不平衡、民族平等理論政策及立法質(zhì)量三方面因素后作出的規(guī)定,其受權(quán)主體有明顯的特殊性。法律變通實(shí)施權(quán)在確立之初的性質(zhì)是地方立法權(quán),此后法律變通實(shí)施權(quán)中的一部分開始向立法自治權(quán)轉(zhuǎn)變,但刑法變通實(shí)施權(quán)一直未做改變。將刑法變通實(shí)施權(quán)調(diào)整為國(guó)家立法權(quán),由全國(guó)人大常委會(huì)制定單行刑法來(lái)解決刑法變通實(shí)施問題是一種新的思路。
[Abstract]:Article 90 of the Criminal Law establishes the right of alternative implementation of criminal law, and the academic circles misread the right, the main reason is that the nature of the right is not clear. Article 90 of the Criminal Law is a comprehensive consideration by legislators of the imbalance of the development of the minority society in our country. The authorized subject of the national equality theory, policy and legislation quality has obvious particularity. The nature of the power of enforcement of legal adaptation at the beginning of its establishment is local legislative power. Since then, part of the power of enforcement of adaptation of law has begun to change to the power of legislative autonomy, but the power of enforcement of alternative enforcement of criminal law has not been changed. It is a new way to adjust the power of flexible implementation of criminal law to the power of national legislation and to make a single criminal law by the standing Committee of the National people's Congress to solve the problem of flexible implementation of criminal law.
