【摘要】：大數(shù)據(jù)時(shí)代,侵犯網(wǎng)絡(luò)版權(quán)犯罪不斷發(fā)生,呈現(xiàn)犯罪主體廣泛,犯罪客體形式多樣;犯罪手段多樣,危害性嚴(yán)重;犯罪目的不明確等特點(diǎn)。刑法在侵犯網(wǎng)絡(luò)版權(quán)保護(hù)的理念,侵犯網(wǎng)絡(luò)版權(quán)犯罪的入罪、定罪需考慮的因素等方面面臨巨大挑戰(zhàn),亟待探尋相關(guān)應(yīng)對(duì)策略,從而實(shí)現(xiàn)對(duì)網(wǎng)絡(luò)版權(quán)的有效保護(hù)。
[Abstract]:In the era of large data, the infringement of the network copyright crime has occurred, the main body of the crime is presented, the form of the crime object is various, the crime means are various, the harmfulness is serious, the criminal purpose is not clear and the like. The criminal law is faced with great challenges in violation of the concept of network copyright protection, the crime of infringing on the crime of network copyright, the factors that need to be considered, and it is urgent to explore the related strategies, so as to realize the effective protection of the copyright of the network.
