【摘要】：公交特許經(jīng)營(yíng)制度是在政府管理的公共交通領(lǐng)域引入民營(yíng)資本,將公共交通領(lǐng)域的經(jīng)營(yíng)活動(dòng)部分或全部交由私營(yíng)主體經(jīng)營(yíng),通過政府依法引導(dǎo)市場(chǎng)科學(xué)運(yùn)營(yíng),來(lái)實(shí)現(xiàn)公共交通事業(yè)高速發(fā)展目標(biāo)的制度。該制度的研究主要以法律對(duì)公交經(jīng)營(yíng)的規(guī)制為核心,論述公交事業(yè)從政府壟斷經(jīng)營(yíng)到政府嚴(yán)格管理再到現(xiàn)在政府與私營(yíng)主體的共同治理的發(fā)展歷程。筆者通過分析公交特許經(jīng)營(yíng)中政府與私營(yíng)主體公私合作的可能性、行政行為強(qiáng)制性的弱化表現(xiàn)以及政府管理公共事務(wù)時(shí)管理理念和角色的轉(zhuǎn)變,從而探索到我國(guó)行政法發(fā)展與改革的方向應(yīng)該是加強(qiáng)政府與公眾的互動(dòng)與合作,共同完成公共事業(yè)的發(fā)展與治理目標(biāo)。
[Abstract]:The system of public transport franchise is to introduce private capital into the field of public transport managed by the government, give part or all of the management activities in the field of public transport to the private main body, and guide the scientific operation of the market through the government according to law. To achieve the goal of rapid development of public transport. The research of this system is mainly based on the regulation of public transport management by law. This paper discusses the development course of public transport from government monopoly management to strict government management and to the common governance between government and private subject. The author analyzes the possibility of public-private cooperation between government and private main body in public transport franchise. In order to explore the direction of the development and reform of administrative law in China, the direction of the development and reform of administrative law should be to strengthen the interaction and cooperation between the government and the public. Work together to achieve the development and governance goals of public utilities.
