【摘要】：隨著行政政府向服務(wù)政府轉(zhuǎn)型深入，各國政府正積極推進政府信息公開，建立透明政府、陽光政府成為世界主流趨勢。信息保密審查機制作為政府信息公開制度中不可缺少的重要環(huán)節(jié)，在政府主動公開和依申請公開的信息中，哪些涉及國家秘密、如何認定、認定程序、定密錯誤后處理程序都是政府信息公開制度的重要問題。保密審查機制為政府信息公開與保密劃清具體界限，也直接影響著政府信息公開制度發(fā)展。 在我國長達兩千年的封建制度下，“法藏于府，威嚴莫測”的政治傳統(tǒng)深入社會各個階層，政府機關(guān)在大眾眼中披著神秘面紗。隨著法治社會理念的傳播，建立法治政府，依法治國成為我國政府執(zhí)政目標(biāo)，政府信息公開制度得以建立和實施，《中華人民共和國政府信息公開條例》（以下簡稱《條例》），標(biāo)志著政府信息公開制度在我國初步建立�！稐l例》中，明確政府信息含義，政府信息公開范圍，規(guī)范政府信息公開程序、方式，并特別規(guī)定保密審查制度、監(jiān)督和相關(guān)保障制度等內(nèi)容。 《條例》實施后，在中央政府的大力推動下，各級地方政府均作出積極的響應(yīng)，根據(jù)《立法法》規(guī)定,我國共有80個地方政府有權(quán)制定地方性法規(guī)或地方政府規(guī)章(以下簡稱為地方規(guī)定)。在《條例》制定前,截至2006年11月15日，共有34個地方專門制定信息公開地方規(guī)定�！稐l例》公布以來，，8個已經(jīng)制定地方規(guī)定的對原規(guī)定依據(jù)《條例》進行相應(yīng)的修訂。這種成果是鼓舞人心的，也是我國行政理念轉(zhuǎn)變的具體表現(xiàn)，但是隨著《條例》實施的時間增長，社會實際情況的變化，一些在立法層面和制度層面的缺陷和不足日益凸顯。

Information security review mechanism as an important link in the system of government information disclosure, the government actively open and in accordance with the disclosed information, which involves state secrets, how to identify, identification procedures, classification error postprocessing procedures are an important issue for the government information disclosure system. Security review mechanism for government information disclosure and confidentiality draw specific boundaries, but also influences the development of government information disclosure system.
The feudal system in China for two thousand years, "hidden in the palace, dignified and unpredictable political tradition into all sectors of society, the government in the eyes of the public a mystery. With the dissemination of ideas of the rule of law, establish a government ruled by law, the rule of law has become our government target, the government information disclosure system is established and the implementation of" People's Republic of China Government Information Disclosure Ordinance "(hereinafter referred to as the regulations), marking the government information disclosure system in China was established. The regulations on government information, clear meaning, the scope of the disclosure of government information, government information disclosure norms, procedures, and special provisions on the confidentiality examination system, supervision and security system etc. content.
After the implementation of regulations, vigorously promote the central government and local governments at all levels to make a positive response, according to the provisions of the legislation law, there are 80 local governments have the right to formulate local regulations or local government regulations (hereinafter referred to as local regulations). The regulations formulated before, as of November 15, 2006 a total of 34 places, devoted to the development of the information disclosure requirements of the local regulations. "Since the announcement, 8 have formulated local regulations on the original provisions according to regulations revising.
