【摘要】：中國新聞法制存在兩個有價值的傳統(tǒng):注冊登記制、平衡理念。我國新聞法制建設必須直面現(xiàn)實、注重方法、講求實效,善于從歷史傳統(tǒng)中汲取資源,開拓接續(xù)傳統(tǒng)、超越傳統(tǒng)的法制建設新思維。接續(xù)、超越這些傳統(tǒng)的路徑有四條:首先,從兩個新聞法律的鄰接性文本——新聞道德和傳媒司法——中找到中國新聞法制建設的啟發(fā)性出口;其次,在中國新聞法制建設無本質突破的現(xiàn)實中發(fā)現(xiàn)前進的坦途,即壓力型立法的路徑:一是傳播科技壓迫新聞法制變革,二是具有"痛感"和"快感"之事逼迫新聞法制發(fā)展。
[Abstract]:There are two valuable traditions in China's journalistic legal system: registration and registration system, balanced concept. The construction of China's journalistic legal system must face reality, pay attention to methods, pay attention to practical results, be good at drawing resources from historical traditions, and open up successive traditions. There are four ways to transcend the traditional legal system construction: first, to find the enlightening export of the construction of Chinese news legal system from the two adjacent texts of news law-news morality and media judicature; and second, to find the enlightening export of the construction of Chinese news legal system. In the reality that there is no essential breakthrough in the construction of Chinese news legal system, we can find a smooth way forward, that is, the path of pressure-type legislation: first, spreading science and technology to oppress the news legal system reform, and second, forcing the development of the news legal system with "pain" and "pleasure".
