我國(guó)房屋限購(gòu)令的行政法思考

【摘要】:住房問(wèn)題一直是關(guān)乎我國(guó)國(guó)計(jì)民生的大問(wèn)題。當(dāng)今,房?jī)r(jià)高漲,“住房難”、“購(gòu)房難”已經(jīng)成為了人民群眾普遍關(guān)心的重要問(wèn)題。為了控制房?jī)r(jià)的過(guò)快上漲,實(shí)現(xiàn)到“居者有其所”的安居目標(biāo)。近年來(lái),我國(guó)政府對(duì)房地產(chǎn)市場(chǎng)進(jìn)行了多次調(diào)控。在黨的十八大報(bào)告中,明確提出建立政府保障與市場(chǎng)配置相結(jié)合的住房保障制度,即“雙軌制”。由政府主導(dǎo)、房地產(chǎn)市場(chǎng)的經(jīng)營(yíng)者參與,一起建設(shè)保障性住房,加快建設(shè)保障性住房,努力解決老百姓的住房難的問(wèn)題。 在國(guó)家的調(diào)控房地產(chǎn)市場(chǎng)的政策中,房屋限購(gòu)令一直都是國(guó)家調(diào)控房?jī)r(jià)的最為核心的政策。在2014年3月5日李克強(qiáng)總理在全國(guó)兩會(huì)作的政府工作報(bào)告中,再次提到了要解決我國(guó)人民“住房難”的問(wèn)題,此舉足以彰顯國(guó)家打壓不正常房?jī)r(jià),降溫房地產(chǎn)市場(chǎng),保障民生的堅(jiān)定決心。 從“國(guó)十一條”、“國(guó)十條”、“國(guó)八條”再到“新國(guó)五條”,房屋限購(gòu)令的規(guī)定越來(lái)越嚴(yán)格,限購(gòu)條件也越來(lái)越苛刻。由于限購(gòu)令涉及的面比較廣,觸動(dòng)的社會(huì)利益比較大。所以限購(gòu)令的出臺(tái),便引起社會(huì)的激烈討論,社會(huì)評(píng)價(jià)褒貶不一。有的拍手稱(chēng)好,給久病不愈的房地產(chǎn)市場(chǎng)下了一劑猛藥。有的認(rèn)為房屋限購(gòu)令的合法性有待商榷,與依法行政原則、行政比例原則相沖突,也不是遵循應(yīng)急性原則而作出。因此,從法律的角度對(duì)房屋限購(gòu)令的合法性進(jìn)行分析和研究,在倡導(dǎo)法治社會(huì)建設(shè)的今天,對(duì)于保障公民住房的合法權(quán)益顯得尤為必要。 全文從房屋限購(gòu)令出臺(tái)的背景、性質(zhì)、特征、法理基礎(chǔ)、行政合法性分析、行政合理性分析以及完善建議等幾個(gè)方面對(duì)房屋限購(gòu)令進(jìn)行了系統(tǒng)性的論述。 文章的第一部分,主要是對(duì)房屋限購(gòu)令的概述。從房屋限購(gòu)令出臺(tái)的背景、抽象行政行為性質(zhì)、特征等方面對(duì)房屋限購(gòu)令加以論述,陳述房屋限購(gòu)令出臺(tái)的背景及法律基礎(chǔ)。 文章的第二部分,主要陳述房屋限購(gòu)令的法理基礎(chǔ),闡述了房屋限購(gòu)令的法哲學(xué)、憲法基礎(chǔ)。分別從法哲學(xué)、憲法學(xué)的角度論述房屋限購(gòu)令存在的法理基礎(chǔ),是國(guó)家經(jīng)濟(jì)職能觀念強(qiáng)化的表現(xiàn),同時(shí)也是憲法賦予國(guó)家宏觀調(diào)控權(quán)的表現(xiàn)形式。 文章的第三部分,從房屋限購(gòu)令在短期內(nèi)可以肅清房產(chǎn)秩序,迅速降溫房?jī)r(jià),到長(zhǎng)期可以維護(hù)房地產(chǎn)市場(chǎng)的穩(wěn)定發(fā)展兩個(gè)方面指出我國(guó)目前房地產(chǎn)市場(chǎng)的情況需要房屋限購(gòu)令來(lái)調(diào)控。另外從房屋限購(gòu)令能夠有效引導(dǎo)、調(diào)控我國(guó)房?jī)r(jià)來(lái)分析其作用,并對(duì)其現(xiàn)實(shí)合理性加以論述。 文章的第四部分,從行政法的角度對(duì)房屋限購(gòu)令的合法性進(jìn)行評(píng)析,從依法行政原則、行政比例原則等方面指出房屋限購(gòu)令存在的不足,同時(shí)房屋限購(gòu)令也不是遵循應(yīng)急性原則的作出。進(jìn)一步論述了其與行政立法原則相沖突的地方,為完善房屋限購(gòu)令奠定了理論基礎(chǔ)。 文章的第五部分,主要在第四部分的基礎(chǔ)上,提出完善房屋限購(gòu)令的一些建議。房屋限購(gòu)令法治化是當(dāng)今我國(guó)完善房屋限購(gòu)令一條好的出路,也是行政法治的必然要求,要把房地產(chǎn)市場(chǎng)一步步法治化。 房屋限購(gòu)令的具體完善途徑主要從完善行政規(guī)范性文件的制定程序,以及加強(qiáng)立法、行政、司法三個(gè)方面的監(jiān)督機(jī)制,才能達(dá)到對(duì)房地產(chǎn)市場(chǎng)調(diào)控的最佳效果。如此之舉不僅能夠很好的穩(wěn)定房?jī)r(jià),還能更好的促進(jìn)房地產(chǎn)市場(chǎng)的健康發(fā)展。最后提出了房屋限購(gòu)令的退出機(jī)制,由于房屋限購(gòu)令是一項(xiàng)國(guó)家的宏觀調(diào)控措施,對(duì)房?jī)r(jià)的調(diào)整也只能是臨時(shí)性。在適當(dāng)?shù)臅r(shí)期,當(dāng)房?jī)r(jià)長(zhǎng)期趨于穩(wěn)定,或者國(guó)家找到一條更好的調(diào)整房?jī)r(jià)的途徑以后,其注定要退出歷史舞臺(tái)。 筆者認(rèn)為,對(duì)于房屋限購(gòu)令這種行政調(diào)控手段,既不能一棒子打死,也不能任意放縱。要通過(guò)建立一系列有效的法律機(jī)制,規(guī)范房屋限購(gòu)令。這也是本文的重點(diǎn)以及創(chuàng)新之處。 論文前期研究準(zhǔn)備中,筆者查閱相關(guān)房屋限購(gòu)令的資料,主要采用了歷史唯物主義的哲學(xué)方法論、文獻(xiàn)查閱法、文獻(xiàn)分析法等研究方法來(lái)研讀、探析我國(guó)房屋限購(gòu)令。
[Abstract]:The housing problem is always a big problem for our country. The prices are beneficial to the people's livelihood, and "housing", "housing difficult" has become an important issue of common concern to the people. In order to control the rapid rise of prices, to achieve the "home ownership housing goals". In recent years, the government of our country a number of regulation on the real estate market. In eighteen big reports of the party put forward clearly, the housing security system to establish a government guarantee and market allocation of the combination, namely the "double track". Led by the government, the operators of the real estate market participation, together with the construction of affordable housing, accelerate the construction of affordable housing, to solve the old the people of the housing problem.
In the state of the real estate market regulation policy, the purchase of housing that is always the most core national price regulation policy. In March 5, 2014, Premier Li Keqiang at the national NPC and CPPCC in the government work report, once again referred to the people of our country to solve the "housing difficult" problem, this is enough to highlight the national pressure is not the normal price, to cool the real estate market, safeguard the firm determination of the people's livelihood.
From the "country of eleven", "ten", "eight" and "five new country", housing purchase order requires more and more strict, the purchase conditions are increasingly demanding. The restriction that relates to a wide range, touched the interests of society so the relatively large. The purchase order issued, it caused intense discussion of the society, the society mixed reviews. Some applaud, to the long illness of the real estate market a agents. Some believe that the purchase of housing legitimacy to questionable, and the principles of administrative law, the administrative conflict with the principle of proportionality, nor follow the principle of emergency and made. Therefore, the analysis and Research on the legitimacy of the housing purchase order from a legal perspective, in promoting the construction of the rule of law today, for the protection of the legitimate rights and interests of citizens housing is particularly necessary.
From the background, nature, characteristics, jurisprudence basis, administrative legitimacy analysis, administrative rationality analysis and suggestions for improvement, the paper makes a systematic discussion on the housing restriction order.
The first part of the article is an overview of the housing restriction order. From the background of the introduction of the housing restriction order, the nature and characteristics of the abstract administrative act, the paper discusses the housing purchase order, and states the background and legal basis of the housing restriction order.
The second part of the article, mainly stated the purchase of housing to the legal basis, elaborated the housing restriction that the philosophy of law, constitutional basis. From the philosophy of law, constitutional law and discusses the legal basis of the existence of the purchase of housing, is the national economic function concept to strengthen performance, form and constitutional state the macro-control power.
The third part of the article, from the housing purchase restrictions in the short term can eliminate property order, rapid cooling of prices, to the real estate market to maintain long-term stable development of two aspects pointed out that China's current real estate market situation in need of housing purchase restrictions. In addition to the regulation from the housing purchase restrictions can effectively guide the analysis the role of price regulation in China, and discusses the rationality of the reality.
The fourth part of the article, the comment on the purchase of housing legal order from the perspective of administrative law, from the principles of administrative law, administrative proportion principle that the purchase of housing shortages that exist at the same time, the purchase of housing is not to follow the principle of acute should make the further. With the principle of administrative legislation places of the conflict, in order to improve the housing purchase restrictions laid a theoretical foundation.
The fifth part of the article, mainly on the basis of the fourth part, put forward some suggestions to improve the purchase of housing. The housing purchase restrictions is the rule of law in China to improve the housing purchase restrictions in a good way, but also the inevitable requirement of administrative law, the real estate market step by step and rule of law.
The purchase of housing for specific measures to perfect the development process from the main administrative normative documents, and strengthen the legislative, administrative and judicial supervision mechanism in three aspects, in order to achieve the best effect of the regulation of the real estate market. So it can not only stabilize prices good, can better promote the healthy development of the real estate market finally, the purchase of housing. The exit mechanism, because the purchase order is a national macro-control measures, the price adjustment is only temporary. At the appropriate time, when the long-term stable prices, or the national way to find a better price adjustment, it is destined to exit the stage of history.
The author believes that for the administrative control means of housing purchase restriction, we can neither kill a single stick or arbitrarily indulge in it. We need to establish a series of effective legal mechanisms to regulate the purchase restriction order. This is also the focus and innovation of this paper.
In the preliminary research preparation, I consulted the relevant housing restriction orders, mainly using historical materialism philosophy methodology, literature review method, literature analysis method and other research methods to explore the restriction of housing purchase in China.
