【摘要】：實(shí)行監(jiān)察體制改革,組建監(jiān)察委員會(huì),建立集中統(tǒng)一、權(quán)威高效的監(jiān)察體系,作為一項(xiàng)事關(guān)全局的重大政治體制改革,改變了憲法規(guī)定的國(guó)家機(jī)構(gòu)體系,創(chuàng)設(shè)了新的國(guó)家機(jī)關(guān),并且對(duì)既有國(guó)家機(jī)關(guān)的權(quán)力進(jìn)行了重新配置,引起了既有組織法律體系的大幅度變更。國(guó)家監(jiān)察體制改革應(yīng)當(dāng)立法先行。作為涉及到憲法體制的國(guó)家機(jī)構(gòu)調(diào)整,不是一部《國(guó)家監(jiān)察法》所能完成的,必須按照組織法定主義原則,修改憲法,制定《監(jiān)察委員會(huì)組織法》,規(guī)定監(jiān)察委員會(huì)的產(chǎn)生、組成和職權(quán),理順國(guó)家監(jiān)察機(jī)關(guān)與檢察機(jī)關(guān)等其他國(guó)家機(jī)關(guān)的關(guān)系,從組織法上保障國(guó)家監(jiān)察機(jī)關(guān)依據(jù)《國(guó)家監(jiān)察法》規(guī)定的監(jiān)察任務(wù)、權(quán)限和程序履行法定職責(zé),實(shí)現(xiàn)國(guó)家監(jiān)察法治化。
[Abstract]:The implementation of the reform of the supervisory system, the formation of supervisory committees, the establishment of a centralized, unified, authoritative and efficient supervisory system, as a major political structural reform affecting the overall situation, has changed the constitutional system of state institutions and created new state organs. Moreover, the power of the existing state organs has been reconfigured, which has caused a great change in the legal system of the existing organizations. The reform of the state supervision system should be legislated first. As the readjustment of state institutions involving the constitutional system is beyond the reach of a "State Supervision Law", it is necessary to amend the Constitution in accordance with the principle of organization and legalism, formulate the Organic Law of the Supervisory Commission, and provide for the formation of the supervisory committee. To organize the relationship between the state supervisory organs and other state organs, such as procuratorial organs, and to ensure, from the organic law, the supervisory tasks, powers and procedures stipulated by the state supervisory organs in accordance with the "State Supervision Law" to perform their statutory duties, The implementation of state supervision of the rule of law.
