交通運(yùn)輸行政立法評(píng)估研究

【摘要】:改革開放以來(lái),我國(guó)交通運(yùn)輸立法工作成果明顯,基本上解決了無(wú)法可依的問(wèn)題,為實(shí)現(xiàn)依法行政奠定了較為堅(jiān)實(shí)的基礎(chǔ)。大部制改革后,交通運(yùn)輸行業(yè)管理領(lǐng)域和執(zhí)法門類都有所拓展,對(duì)交通運(yùn)輸主管部門提出了更高的要求和責(zé)任。因此,如何在降低立法成本的基礎(chǔ)上,既加強(qiáng)立法項(xiàng)目實(shí)施效果監(jiān)督,又改進(jìn)立法問(wèn)題是擺在交通運(yùn)輸行業(yè)亟待解決的課題。國(guó)際社會(huì)立法評(píng)估的經(jīng)驗(yàn)告訴我們,通過(guò)統(tǒng)一規(guī)范的評(píng)估制度對(duì)已施行的立法項(xiàng)目進(jìn)行評(píng)估,是提高立法質(zhì)量的有效途徑。交通運(yùn)輸部《關(guān)于開展交通立法后評(píng)估工作的指導(dǎo)意見》(交體法發(fā)(2009)33號(hào))印發(fā)以來(lái),行業(yè)內(nèi)相繼開展了一些有益探索,并收獲了許多寶貴經(jīng)驗(yàn)。然而,交通運(yùn)輸行業(yè)研究立法評(píng)估還不夠深入,立法評(píng)估體制建設(shè)還不夠統(tǒng)一規(guī)范,監(jiān)督保障立法評(píng)估實(shí)施的措施相對(duì)缺乏等原因,導(dǎo)致部分單位和機(jī)構(gòu)對(duì)開展立法評(píng)估不積極、不重視、不認(rèn)可。 本文在簡(jiǎn)述交通運(yùn)輸立法評(píng)估理論、歸納交通運(yùn)輸立法評(píng)估現(xiàn)狀、總結(jié)評(píng)估問(wèn)題、分析國(guó)內(nèi)和國(guó)外立法評(píng)估實(shí)例基礎(chǔ)上,重點(diǎn)探索構(gòu)建適合交通運(yùn)輸行業(yè)的立法評(píng)估制度。引言主要是對(duì)選取《交通運(yùn)輸行政立法評(píng)估研究》這個(gè)題目的原因進(jìn)行簡(jiǎn)要說(shuō)明,簡(jiǎn)述交通運(yùn)輸部對(duì)于開展立法評(píng)估的認(rèn)識(shí)程度,以及行業(yè)內(nèi)開展立法評(píng)估的現(xiàn)狀。正文共四部分,具體框架如下:一是介紹交通運(yùn)輸立法評(píng)估制度的相關(guān)理論。從對(duì)交通運(yùn)輸行政立法評(píng)估概念的理解,到對(duì)一般特征和行業(yè)特征的歸納,再到對(duì)立法評(píng)估意義的分析;二是歸納國(guó)內(nèi)交通運(yùn)輸行業(yè)開展立法評(píng)估工作的情況,并總結(jié)評(píng)估工作中存在的問(wèn)題,為進(jìn)一步規(guī)范、改進(jìn)交通運(yùn)輸立法評(píng)估提供實(shí)證參考;三是通過(guò)對(duì)國(guó)內(nèi)外立法評(píng)估實(shí)例的介紹和分析,總結(jié)他們的成果和不足,為尚處于起步階段的交通運(yùn)輸行政立法評(píng)估提供學(xué)習(xí)和借鑒的依據(jù);四是嘗試構(gòu)建適合交通運(yùn)輸行業(yè)的立法評(píng)估體制,體制建設(shè)涉及交通運(yùn)輸立法評(píng)估的主體、對(duì)象、標(biāo)準(zhǔn)、方法、程序等方面,努力通過(guò)建立完備、系統(tǒng)、科學(xué)的立法評(píng)估體制,規(guī)范交通運(yùn)輸行業(yè)立法評(píng)估工作的實(shí)施和管理,推進(jìn)交通運(yùn)輸行業(yè)在立法評(píng)估工作的制度化和法制化進(jìn)程。
[Abstract]:Since the reform and opening up, our country traffic transportation legislation work achievement is obvious, basically has solved the question which cannot depend on, has laid a more solid foundation for realizing the administration by law. After the reform of the Ministry of Transport, the management field and the law enforcement category of the transportation industry have been expanded, and higher requirements and responsibilities have been put forward to the traffic and transportation departments. Therefore, on the basis of reducing the cost of legislation, it is an urgent task to strengthen the supervision of the effect of the implementation of the legislative project and to improve the legislation in the transportation industry. The experience of legislation evaluation in international society tells us that it is an effective way to improve the quality of legislation to evaluate the legislative items implemented through the unified and standardized evaluation system. Since the publication of the Ministry of Transport's guidance on the Post-Legislative Evaluation of Traffic (2009) 33, some beneficial explorations have been carried out in the industry, and many valuable experiences have been gained. However, the research on the legislative evaluation of the transportation industry is not deep enough, the construction of the legislative evaluation system is not uniform and standardized, and the measures to monitor and guarantee the implementation of the legislative evaluation are relatively lacking. As a result, some units and institutions to carry out legislative evaluation is not active, do not attach importance to, do not recognize. On the basis of summarizing the theory of legislative evaluation of traffic and transportation, summarizing the present situation of legislative evaluation of traffic and transportation, summing up the evaluation problems and analyzing the domestic and foreign cases of legislative evaluation, this paper focuses on the construction of a legislative evaluation system suitable for the traffic and transportation industry. The preface is mainly to briefly explain the reasons for selecting the topic of "Research on the Evaluation of Traffic and Transportation Administration and legislation", and briefly introduce the understanding degree of the Ministry of Transport to carry out the legislative evaluation and the present situation of carrying out the legislative evaluation in the industry. The main body has four parts, the specific frame is as follows: first, introduces the traffic transportation legislation appraisal system correlation theory. From the understanding of the concept of administrative and legislative evaluation of traffic and transportation, to the induction of general characteristics and industry characteristics, and to the analysis of the significance of legislative evaluation, the second is to sum up the situation of the domestic transportation industry in carrying out the legislative evaluation work. And summarizes the problems in the evaluation work, for further standardization, improve the traffic and transport legislation evaluation to provide empirical reference; third, through the introduction and analysis of domestic and foreign legislative evaluation examples, summed up their achievements and shortcomings, The fourth is to try to build a legislative evaluation system suitable for the transportation industry, which involves the subject, object and standard of the legislative evaluation of traffic and transportation.
