【摘要】：當選無效之訴是臺灣地區(qū)司法介入政治選舉、政治爭議司法解決的一種重要形式,對于維護選舉秩序,確保選舉的公平公正具有積極作用。在"公職人員選舉罷免法"第120、121條規(guī)定的條件下,選舉委員會、檢察官和候選人可以針對當選人提起當選無效之訴。不過法律條文中的一些概念不確定,當選無效的具體事由存在爭議。從當選無效之訴的司法實務可以看出,由于法官裁判思維的法律形式主義傾向,追求公正、干凈的選舉結(jié)果的立法目的難以通過司法實踐完全實現(xiàn)。
[Abstract]:The case of invalid election is an important form of judicial intervention in political elections and judicial settlement of political disputes in Taiwan, which plays an active role in maintaining the electoral order and ensuring the fairness and fairness of the election. Subject to section 120121 of the Act on the Electoral recall of Public officials, the Election Commission, the Public Prosecutor and the candidate may file a suit against the elected person for invalidity. But some of the concepts in the law are uncertain, and the exact cause of invalidity is disputed. It can be seen from judicial practice that due to the legal formalism tendency of judges' judgment thinking, the legislative purpose of pursuing fair and clean election results is difficult to be fully realized through judicial practice.
