【摘要】： 2007年11月20日,第13屆東盟首腦會(huì)議簽署通過了《東盟憲章》(THE ASEAN CHARTER),并于2008年12月15日在雅加達(dá)舉行的東盟外長會(huì)議上正式生效。作為東盟成立40年來第一份具有普遍法律約束力的組織章程文件,該憲章確立了東盟的發(fā)展目標(biāo)、原則、地位、架構(gòu)以及其他相關(guān)內(nèi)容,正式賦予東盟以國際法意義上的法律人格,優(yōu)化了組織機(jī)構(gòu),加強(qiáng)了該組織與各成員國之間的協(xié)調(diào),意在推動(dòng)?xùn)|盟不論是在思想上還是在實(shí)踐上,實(shí)現(xiàn)從松散的地區(qū)組織向以憲章為指導(dǎo)的制度化的共同體的根本轉(zhuǎn)變。憲章的誕生標(biāo)志著醞釀已久的東盟共同體建設(shè)終于有了法律規(guī)范和制度保障,是東盟發(fā)展歷史上的一個(gè)重要里程碑,對(duì)于推動(dòng)未來東盟地區(qū)的和平、穩(wěn)定、繁榮與發(fā)展將發(fā)揮重要作用。 《東盟憲章》為東盟的地區(qū)合作開啟了一個(gè)新的時(shí)代,為東盟未來的發(fā)展方向確立了一個(gè)明確的目標(biāo),規(guī)定了共同體發(fā)展的宗旨和原則,“東盟共同體”建設(shè)從此步入正軌,東盟朝向其成立宣言中所倡導(dǎo)的“東南亞國家共同體”的目標(biāo)又邁進(jìn)了一步。對(duì)東盟而言,能否如期在2015年建成以政治—安全共同體、經(jīng)濟(jì)共同體和社會(huì)—文化共同體為支柱的東盟共同體,有賴于《東盟憲章》指導(dǎo)下的東盟地區(qū)主義的高度發(fā)展和東盟各成員國之間互信的形成,這將是一個(gè)艱巨的任務(wù),目前這一進(jìn)程已經(jīng)起步,地區(qū)整合的大趨勢也將不可逆轉(zhuǎn)。 相應(yīng)的,《東盟憲章》與東盟共同體建設(shè)作為一個(gè)新的研究領(lǐng)域已經(jīng)引起國內(nèi)外學(xué)界的廣泛關(guān)注。本文把對(duì)《東盟憲章》的解讀作為切入點(diǎn),將《東盟憲章》以及東盟共同體建設(shè)的研究置于地區(qū)主義的理論視角與分析框架下,通過分析其內(nèi)在的關(guān)系來深入探究“東盟共同體”的建構(gòu)進(jìn)程,引發(fā)對(duì)東盟地區(qū)主義發(fā)展及東盟共同體建設(shè)的深入思考。本文主要選用文獻(xiàn)分析法、歷史分析法和實(shí)證分析法作為主要的研究方法。全文主體架構(gòu)共分為五部分。第一部分為導(dǎo)論,主要包括問題的提出及選題意義、國內(nèi)外研究綜述、論文的邏輯思路與研究方法等內(nèi)容；第二部分為理論架構(gòu),以現(xiàn)有的地區(qū)主義理論來探討東盟地區(qū)合作與共同體建設(shè)的內(nèi)在規(guī)律與理論內(nèi)涵,為全文的內(nèi)容分析構(gòu)建相應(yīng)的理論框架；第三部分重點(diǎn)解讀《東盟憲章》這部文獻(xiàn),通過對(duì)憲章誕生的背景和具體內(nèi)容的分析來探究其對(duì)于東盟共同體建設(shè)的指導(dǎo)意義；第四部分是本文著墨最多的一章,主要從歷史與現(xiàn)實(shí)相結(jié)合的角度展開分析《東盟憲章》指導(dǎo)下的東盟共同體建設(shè),對(duì)共同體建設(shè)的發(fā)展歷史、進(jìn)程特點(diǎn)、動(dòng)力和制約因素等內(nèi)容進(jìn)行深度探討；最后在第五部分結(jié)語中對(duì)全文內(nèi)容進(jìn)行總結(jié),對(duì)《東盟憲章》指導(dǎo)下的東盟地區(qū)合作尤其是共同體建設(shè)發(fā)展前景做出展望。
[Abstract]:On November 20, 2007, the 13th ASEAN Summit signed and adopted the "ASEAN Charter" and the ASEAN ASEAN Charter, which came into effect at the ASEAN Foreign Ministers' meeting held in Jakarta on December 15, 2008. As the first universal legally binding constitutional document of ASEAN in its 40 years of existence, the Charter establishes ASEAN's development goals, principles, status, architecture and other relevant elements. Formally endowing ASEAN with a legal personality in the sense of international law, optimizing the organization and strengthening coordination between the organization and its member States, with a view to promoting ASEAN, both ideologically and practically, To realize the fundamental transformation from loose regional organization to an institutionalized community guided by the Charter. The birth of the Charter marks that the long-simmering building of the ASEAN Community has finally had legal norms and institutional guarantees, which is an important milestone in the history of ASEAN development and will promote peace and stability in the future ASEAN region. Prosperity and development will play an important role. The ASEAN Charter has opened a new era for ASEAN regional cooperation, set a clear goal for ASEAN's future development, and laid down the purposes and principles for the development of the ASEAN Community, and the building of the "ASEAN Community" has been on the right track since then. ASEAN has taken another step towards the goal of the Community of Southeast Asian Nations, as advocated in its founding declaration. For ASEAN, will it be possible to establish, by 2015, the ASEAN Community, supported by the political and Security Community, the Economic Community and the Socio-Cultural Community, Depending on the high development of ASEAN regionalism under the guidance of the ASEAN Charter and the formation of mutual trust among ASEAN member countries, this will be a difficult task. At present, this process has already begun, and the general trend of regional integration will also be irreversible. Accordingly, ASEAN Charter and ASEAN Community Construction as a new research field have attracted extensive attention of scholars at home and abroad. In this paper, the interpretation of the ASEAN Charter is taken as a starting point, and the study of ASEAN Charter and ASEAN Community Construction is put under the theoretical and analytical framework of regionalism. By analyzing its internal relations, this paper probes into the construction process of "ASEAN Community", which leads to deep thinking on the development of ASEAN regionalism and the construction of ASEAN Community. This paper mainly chooses literature analysis, historical analysis and empirical analysis as the main research methods. This paper is divided into five parts. The first part is the introduction, mainly includes the question raising and the topic selection significance, the domestic and foreign research summary, the thesis logic thought and the research method and so on; the second part is the theory framework, Based on the existing regionalism theory, this paper discusses the inherent law and theoretical connotation of ASEAN regional cooperation and community construction, and constructs the corresponding theoretical framework for the content analysis of the full text. Through the analysis of the background and specific content of the Charter to explore its guiding significance for the construction of ASEAN Community. This paper analyzes the ASEAN Community construction under the guidance of the ASEAN Charter from the angle of the combination of history and reality, and probes into the development history, the process characteristics, the motive force and the restrictive factors of the community construction. Finally, in the conclusion of the fifth part, the paper summarizes the content of the full text, and looks forward to the prospect of ASEAN regional cooperation under the guidance of the ASEAN Charter, especially the construction of the community.
