　　隨著全球化進一步深入,中國進一步推進改革開放,各個領(lǐng)域的國際交流也隨著增多。在處理諸多國際事務(wù)中,法律交流作用也越來越突出。然而各國之間的法律交流離不開法律翻譯。近幾年來,我國對法律翻譯的需求量越來越大。法律翻譯方面的研究也受到了學者們的重視。其中,法律術(shù)語是法律翻譯研究一個重要課題。法律術(shù)語翻譯直接影響著法律翻譯的質(zhì)量。 法律術(shù)語是法律語言的核心詞匯,是對法律現(xiàn)象及事物的高度概括。法律術(shù)語也是法律翻譯者面臨的挑戰(zhàn)和難點之一。在具體的法律翻譯實踐中,法律術(shù)語翻譯還是存在一些問題,比如法律術(shù)語的誤譯、法律術(shù)語不一致現(xiàn)象。針對這些問題,本文從功能翻譯理論出發(fā),結(jié)合法律術(shù)語自身的特點,采用了概念分析法,提出了相應(yīng)的翻譯原則與方法。 本文的主要內(nèi)容可以從以下三個方面來闡述。首先,本文從詞源、語義及語體方面分析了法律術(shù)語的特點。這對法律術(shù)語翻譯的可接受性有一定的指導(dǎo)意義。其次,在了解其特點的基礎(chǔ),本文介紹了奈達的功能對等理論,以及Sarcevic的法律翻譯觀點,闡述了功能對等理論在指導(dǎo)法律術(shù)語翻譯中的合適性及意義。最后,基于本文的翻譯理論框架,提出了三大翻譯原則,即法律功能對等原則、語義對等原則...
