法律術語的文化因素及其翻譯策略

術語是現(xiàn)代科學的精髓,法律術語是法學的重要組成部分,法律術語的翻譯在法律文化交流中的作用不言而喻。法律翻譯最重要的問題在于譯者如何解讀不同法律體系下的法律術語在異域語言中的傳達、創(chuàng)制,直到準確無誤地將異域法律文化的法律術語轉(zhuǎn)化為目的語法律文化讀者所能接受的同等表達——即譯文術語。 文化交流及趨同已成為當今社會的潮流。翻譯作為文化交流的主要方式,在兩種不同文化及語言之間架起了一座橋梁,文化因素的作用引起了越來越多翻譯者的注意。眾所周知,若從文化的角度來看翻譯,文化因素是翻譯過程中的主要障礙,文化內(nèi)涵豐富的法律翻譯也不能例外。由此,本文嘗試討論及解決文化因素給法律術語翻譯所帶來的困難。 本文主要由兩部分構(gòu)成。第一部分對文化因素在法律術語翻譯中的體現(xiàn)進行了系統(tǒng)、詳盡的分析,并提出所涉及的文化因素主要包括社會制度、法律體系、法制功能、法律制度及程序、法律文化傳統(tǒng)、文化心理和思維方式的差異,從而揭示了法律翻譯時譯者所面臨的問題。第二部分旨在提出解決法律翻譯過程中的文化因素差異應遵循的原則和策略。
