【摘要】：檢察文書與檢察公信力之間的關(guān)系定位比較新穎,也比較大膽,筆者選取的研究角度是先對(duì)檢察文書和檢察公信力的內(nèi)涵性質(zhì)做基本闡述,揭示了檢察文化和檢察公信力的重要作用與強(qiáng)大的生命力,同時(shí)也揭示出這二者之間存在的實(shí)現(xiàn)手段與追求目標(biāo)的關(guān)系。 檢察文書是檢察機(jī)關(guān)向訴訟當(dāng)事人、訴訟參與人以及社會(huì)公眾集中展示檢察程序和過(guò)程的關(guān)鍵載體,是公眾借以了解和參與檢察活動(dòng)的主要路徑。它并非只簡(jiǎn)單地表現(xiàn)為一紙文字,其中包含著深刻的檢察文化和司法公正的內(nèi)在要求。而檢察公信力是檢察機(jī)關(guān)及其工作人員在行使其職權(quán)的過(guò)程中建立公共信用,從而引發(fā)公眾對(duì)檢察機(jī)關(guān)法律監(jiān)督權(quán)運(yùn)行與結(jié)果的信賴、認(rèn)同與自覺(jué)接受和遵守的程度與狀態(tài)。 檢察文書與檢察公信力之間關(guān)系可以通過(guò)檢察文化和司法公正這兩個(gè)核心因素相連接。具體來(lái)看首先尋找二者對(duì)應(yīng)的司法價(jià)值,確立了檢察公信力作為目標(biāo)的價(jià)值地位,同時(shí)揭示出對(duì)檢察文書所屬的檢察文化和法律文化對(duì)司法公正的體現(xiàn)與實(shí)現(xiàn)；其次再根據(jù)檢察公信力與司法公正之間的密切關(guān)系,從而推出檢察文書與檢察公信力之間存在的實(shí)現(xiàn)手段與目的之間的關(guān)系。 檢察文書在許多人看來(lái)或許只是一個(gè)細(xì)節(jié)問(wèn)題,但它對(duì)檢察公信力的意義卻遠(yuǎn)不止這么簡(jiǎn)單。檢察文書是檢察程序的體現(xiàn),它本身承載著檢察活動(dòng)的程序價(jià)值,也集中體現(xiàn)了檢察活動(dòng)的結(jié)果。對(duì)公眾而言可以通過(guò)檢察文書更好地地認(rèn)識(shí)和了解檢察活動(dòng)和憲法賦予檢察機(jī)關(guān)的法律監(jiān)督職能,從而更好地實(shí)現(xiàn)檢察公信力。 檢察文書與檢察公信力之間存在著深刻的聯(lián)系,但不可否認(rèn)的是現(xiàn)代檢察實(shí)踐活動(dòng)中檢察文書的制作方面仍存在許多弊端,這對(duì)檢察公信力的實(shí)現(xiàn)是很大的障礙,應(yīng)當(dāng)從制作主體、檢察文書內(nèi)容以及檢察文化的內(nèi)在需要的角度去完善和提升檢察文書的制作質(zhì)量,從而提升檢察公信力的水平。
[Abstract]:The relationship between procuratorial documents and procuratorial credibility is relatively novel and bold. The author chooses the perspective of the procuratorial documents and procuratorial credibility of the connotation of the nature of the basic elaboration. It reveals the important role and strong vitality of procuratorial culture and procuratorial credibility, and also reveals the relationship between the means of realization and the pursuit of goals. Procuratorial documents are the key carrier for procuratorial organs to demonstrate the procuratorial procedure and process to litigants, participants and the public. It is the main way for the public to understand and participate in prosecutorial activities. It contains a profound procuratorial culture and the inherent requirements of judicial justice, and the procuratorial credibility is the procuratorial organs and their staff in the exercise of their functions and powers in the process of establishing public credit. Thus, the public trust in the operation and result of the procuratorial organ's legal supervision power, the degree and state of identity and conscious acceptance and compliance. The relationship between procuratorial documents and procuratorial credibility can be linked by the two core factors of procuratorial culture and judicial justice. It establishes the value status of the procuratorial credibility as the target, and at the same time reveals the embodiment and realization of the procuratorial culture and the legal culture of the procuratorial document to the judicial justice. Secondly, according to the close relationship between procuratorial credibility and judicial justice, the relationship between the means of realization and the purpose between procuratorial documents and procuratorial credibility is deduced. Prosecutorial documents may seem to many to be a matter of detail, but they are far more than simple to the credibility of prosecution, which is the embodiment of prosecutorial procedures. It itself carries the procedural value of procuratorial activities. It also reflects the results of procuratorial activities. The public can better understand and understand the procuratorial activities and the legal supervision functions of the procuratorial organs entrusted by the Constitution through the procuratorial documents. In order to achieve better procuratorial credibility. There is a deep connection between procuratorial documents and procuratorial credibility, but it is undeniable that there are still many drawbacks in the production of procuratorial documents in modern procuratorial practice. This is a great obstacle to the realization of procuratorial credibility. We should perfect and improve the quality of procuratorial documents from the perspective of the production subject, the content of procuratorial documents and the inherent needs of procuratorial culture. So as to improve the level of procuratorial credibility.
